The year 2020: Valuing and Rewarding Talents in Public Service

On November 25, 2019, the National Assembly promulgated the Law on Cadres and Public Officials and the amended Law on Public Employees 2019.

According to Clause 2, Article 1 of the 2019 Amended Law on Cadres, Civil Servants, and Public Employees, which amends and supplements Article 6 of the 2008 Law on Cadres and Civil Servants, the State has a policy to discover, attract, utilize, and appropriately reward talented individuals. Particularly, the Government of Vietnam sets the framework policy for utilizing and rewarding talents in public service.

Based on the regulations of the Government of Vietnam, the head of the agency stipulated in Points a, b, c, and d, Clause 1, Article 39 of the 2008 Law on Cadres and Civil Servants decides the policies for utilizing and rewarding talents in public service within their managed agencies, organizations, and units; the provincial-level People's Council prescribes policies for utilizing and rewarding talents in public service within agencies, organizations, and units managed by the province.

Thus, compared to the regulations of the 2008 Law on Cadres and Civil Servants, these amendments are more beneficial to talented civil servants in public service across all industries and fields.

Additionally, this law also amends the definition of a civil servant as follows: "A civil servant is a Vietnamese citizen, recruited, and appointed to a rank, position, or title corresponding to a job position in an agency of the Communist Party of Vietnam, the State, a socio-political organization at central, provincial, or district levels; in an agency or unit of the People's Army that is not an officer, professional soldier, or defense worker; in an agency or unit of the People's Public Security that is not an officer, non-commissioned officer serving under professional policies, or public security worker, in the payroll, and receiving a salary from the state budget." Thus, according to this definition, from July 1, 2020, there will no longer be policies for civil servants in public service providers.
