The State Encourages Enterprises to Give Priority to the Recruitment of Female Workers

Recently, the Government of Vietnam has issued Decree 85/2015/ND-CP detailing a number of provisions of the Labor Code on policies for female workers.

To be specific, according to Clause 2 Article 5 of Decree 85/2015/ND-CP, the state encourages employers to:

- Prioritize the hiring and use of women for jobs if they meet the conditions and standards for work suitable for both men and women;

- Implement policies for female workers that are better than those prescribed by law.

At the same time, the Government of Vietnam stipulates the right to equal employment for female workers as regulated in Clause 1 Article 153 of the Labor Code as follows:

- Employers are responsible for ensuring equality between female and male workers in recruitment, usage, training, wages, rewards, promotion, labor compensation, and policies on social insurance, health insurance, unemployment insurance, working conditions, labor safety, work hours, rest periods, and other welfare policies both materially and spiritually;

- The state ensures equality in all aspects of labor relations, preferential policies, and tax reduction considerations.

Furthermore, this Decree also elaborates on certain provisions of the Labor Code regarding policies for female workers including: Representation of female workers; improvement of working conditions and healthcare for female workers; the right of pregnant female workers to unilaterally terminate or temporarily suspend their labor contracts; assistance and support from employers in building daycare centers, kindergartens, or partly covering childcare, kindergarten expenses; organizing daycare centers and kindergartens in workplaces with many female workers and policies supporting employers.
