The Regime of Social Insurance, Unemployment Insurance, Occupational Accident and Disease Insurance for Coaches and Athletes

On November 08, 2019, the Ministry of Labor, Invalids, and Social Affairs promulgated Circular 18/2019/TT-BLDTBXH providing guidance on the implementation of salaries, training and competition support funds, social insurance, unemployment insurance, labor accident insurance, occupational disease, policies on sickness, maternity, and accidents to coaches and athletes during their training and competition periods.

Circular 18/2019/TT-BLDTBXH provides guidance on the participation in social insurance, unemployment insurance, labor accident insurance, and occupational disease insurance for coaches and athletes during their training and competition periods as follows:

First, for coaches and athletes stipulated at point a, Clause 1, Article 2 of Decree 152/2018/ND-CP, the managing body of the coaches and athletes will continue to participate in social insurance, unemployment insurance, labor accident insurance, and occupational disease insurance as stipulated in Clause 1, Article 4 of Decree 152/2018/ND-CP.

Second, for coaches and athletes stipulated at points b and c, Clause 1, Article 2 of Decree 152/2018/ND-CP, who before being called for training and competition were participating in mandatory social insurance, unemployment insurance, labor accident insurance, and occupational disease insurance under labor contracts at the managing body of coaches and athletes, the participation details are as follows:

- The managing body of coaches and athletes continues to participate in social insurance, unemployment insurance, labor accident insurance, and occupational disease insurance for the coaches and athletes under labor contracts during their training and competition periods as stipulated by law.

- The managing body of coaches and athletes must notify the employing body of the coaches and athletes of the monthly social insurance, unemployment insurance, labor accident insurance, and occupational disease insurance contributions for the coaches and athletes, and the amount that is the responsibility of the coaches and athletes so that the employing body can reimburse as follows:

- In cases where the training and competition period in a month is less than or equal to 50% of the normal working days of the month according to the labor contract, the employing body will reimburse 50% of the monthly insurance contributions of the managing body.

- In cases where the training and competition period in a month is more than 50% of the normal working days of the month according to the labor contract, the employing body will reimburse the full amount of the monthly insurance contributions of the managing body.

- Within 10 working days from the date of receiving the notification from the managing body of the coaches and athletes, the employing body is responsible for transferring the insurance contributions under its responsibility, and simultaneously deducting from the salary of the coaches and athletes the amount for the insurance contributions, which is their responsibility, to transfer to the managing body.

- The time and method for transferring the insurance contributions stipulated at points b and c of this Clause will be agreed upon by the managing body and the employing body, ensuring the participation and benefit of the athletes and coaches in accordance with the regulations.

Third, for coaches and athletes stipulated at points b and c, Clause 1, Article 2 of Decree 152/2018/ND-CP who, before being called for training and competition, are not under the mandatory social insurance, unemployment insurance, labor accident insurance, and occupational disease insurance, the employing body must sign a labor contract and participate in the mandatory insurance for the coaches and athletes according to law.

Fourth, the group of athletes stipulated at point d, Clause 1, Article 2 of Decree 152/2018/ND-CP will implement the labor accident insurance and occupational disease insurance policies as stipulated in Clause 4, Article 4 of Decree 152/2018/ND-CP.
