The Prime Minister to request strengthening the management and use of e-invoices in Vietnam (Internet image) 

Regarding this issue, LawNet would like to answer as follows:

On November 18, 2023, the Prime Minister issued Official Telegram 1123/CD-TTg requesting ministries, branches, and localities to strengthen the management and use of electronic invoices, contributing to promoting digital transformation.

The Prime Minister to request strengthening the management and use of e-invoices in Vietnam

In order to promote the management and use of electronic invoices, contribute to creating an equal, transparent, and favorable business environment for people and businesses, and successfully implement the National Digital Transformation Strategy, the Prime Minister requests the implementation of the following tasks:

(1) The Ministry of Finance presides over and urgently coordinates with ministries and agencies:

- Strengthen propaganda, leadership, direction, and organization of the use of electronic invoices; help people and businesses clearly understand the benefits, responsibilities, and effectiveness of using electronic invoices; and raise taxpayers' awareness of their obligation to comply with tax laws. Propagate and expand the implementation of electronic invoices initiated from cash registers.

- Urgently complete and upgrade the technical infrastructure and information technology system for electronic invoices, ensuring that it meets the requirements of receiving electronic invoice data across the country smoothly and conveniently.

Building a large database center on electronic invoices; applying modern technology; researching appropriate solutions, management tools, and data analysis to manage risks; promptly detecting, preventing, and strictly handling acts of forgery and fraud regarding electronic invoices; contributing to improving the efficiency and effectiveness of tax management.

- Chair and coordinate with the Ministry of Industry and Trade, the Ministry of Science and Technology, the Ministry of Information and Communications, and the People's Committees of provinces and centrally run cities to immediately deploy appropriate, feasible, and effective solutions to closely monitor, strengthen inspection, and check the issuance and use of electronic invoices, especially in making electronic invoices at petroleum retail stores for customers for each sale, ensuring compliance with legal regulations, and strict handling if not implemented or intentionally not implemented.

- Strengthen connection and exchange of information and data with relevant ministries and agencies, especially with the Ministry of Public Security, for effective tax management, especially for e-commerce and business activities on digital platforms, ensuring correct, complete, and timely collection.

- Synchronously and effectively deploy solutions to prevent and combat electronic invoice fraud. Strengthen coordination with the police and relevant ministries and agencies to promptly detect violations of the law and handle them promptly and strictly according to regulations.

(2) The Ministry of Public Security presides over connecting population data with tax authorities, tax administration agencies, and localities to coordinate in detecting and strictly handling violations of non-implementation of electronic invoices; actively and proactively work with ministries, branches, and localities to seriously and effectively implement the Project to develop the application of population data, identification, and electronic authentication to serve national digital transformation in the period 2022–2025, with a vision to 2030 (Project 06).

(3) Ministries, branches, and relevant agencies:

- Accelerate the implementation of digital transformation tasks specified in the National Digital Transformation Strategy; accelerate the progress of connecting the National Population Database with the databases and information systems of ministries and branches; Synchronize population data with civil status, tax, banking, and telecommunications data.

- Coordinate with the Ministry of Finance in connecting and sharing information and data to serve inspection, checking, collating information, serving identification, and electronic authentication of the Ministry of Public Security... to prevent fraud, tax evasion, and tax loss.

(4) People's Committees of provinces and centrally run cities:

- Thoroughly and promptly grasp perspectives and awareness of responsibility for implementing digital transformation locally, which identifies the application of electronic invoices as one of the very important mandatory solutions to carry out the task of digital transformation, especially for electronic invoices for electricity, gasoline, etc.

- Strengthen the close direction of departments and branches to closely coordinate and accompany local tax authorities in propaganda, testing, inspection, management, and use of electronic invoices, improving the efficiency of state management in tax administration and strictly handling according to the law in cases where there are regulations on the use of electronic invoices but they are not implemented.

(5) Assign Deputy Prime Minister Le Minh Khai to drastically and closely direct the implementation of Official Dispatch 1123/CD-TTg.

(6) The Government Office monitors and urges according to assigned functions and tasks.
