The power to approve project investment proposal in Vietnam

On May 04, 2018, the Government of Vietnam issued the Decree No. 63/2018/NĐ-CP on the investment in the form of Public-Private Partnerships (PPP). This Decree applies to ministries, ministerial-level agencies, Governmental agencies, People's Committees of provinces, investors, special purpose entities, lenders and entities involved in investment in the form of PPP.

According to the Decree No. 63/2018/NĐ-CP of Vietnam’s Government, the power to approve project investment proposal is as follows:

1. The National Assembly has power to approve project investment proposal of projects of national importance.

2. The Prime Minister has power to approve project investment proposal of the following:

- Group A projects using at least 30% of central government budget or using under 30% thereof but greater than VND 300 billion in the total investment of the project;

- Group A projects that apply for a BT contract.

3. Ministers, Heads of ministerial-level agencies, Governmental agencies have power to approve project investment proposal of projects other than those prescribed above within their scope of management.

4. The People’s Council of province has power to approve project investment proposal of the following:

- Group A projects other than those prescribed in Clause 2 hereof;

- Group B projects using public investment capital;

- Group B projects that apply for a BT contract.

5. The People's Committee of province has power to approve project investment proposal of projects other than those prescribed above in the province.
