In Official Dispatch 13421-CV/VPTW recently, the Politburo of Vietnam requested an urgent amendment of legal documents stipulating the number of children in a family in Vietnam, to be completed in the first quarter of 2025.

The Office of the Central Committee issued Official Dispatch 13421-CV/VPTW dated February 17, 2025, reviewing the implementation of Resolution 21-NQ/TW dated October 25, 2017, on population work in the new situation and amending the regulations of the Communist Party and State related to population policy.

At the meeting on February 14, 2025, after considering the proposal from the Central Inspection Committee on reviewing the Communist Party's regulations related to handling violations of population policy and opinions from relevant agencies, the Politburo opined:

- Basically agreed with the content and recommendations, proposals stated in the seven-year review report of Resolution 21-NQ/TW of the Central Committee of the 12th Communist Party on population work in the new situation and the results of reviewing the Communist Party's regulations related to handling violations of population policy.

- Agreed to issue the Conclusion of the Politburo on continuing the implementation of Resolution 21-NQ/TW, dated October 25, 2017, of the Central Committee of the 12th Communist Party on population work in the new situation.

Task the Communist Party delegation to the National Assembly and the Communist Party delegation to the Government of Vietnam to coordinate in leading, directing the acceleration of the development and submission of the Law on Population to the National Assembly for approval according to the spirit of the 13th Party Congress Resolution in 2025.

In the immediate future, urgently review and amend legal documents stipulating the number of children (especially Ordinance 06/2003/PL-UBTVQH11 dated January 9, 2003, and Ordinance 08/2008/UBTVQH12 dated December 27, 2008, of the National Assembly Standing Committee) to be completed in the first quarter of 2025.

Additionally, the Politburo also agreed on the policy to develop and implement the National Target Program on Population and Development for the period 2026 - 2035; tasking the Communist Party delegation to the Government of Vietnam to direct the development of this program and submit it to the National Assembly in the third quarter of 2025.

Thus, the main legal documents stipulating the number of children, birth rates in Vietnam such as Ordinance 06/2003/PL-UBTVQH11, Ordinance 08/2008/UBTVQH12, and other related documents will soon be amended in the first quarter of this year.

Additionally, to synchronize with the amendment of legal regulations on the above population issues, the Politburo tasks the Central Inspection Committee with advising, amending the Regulations of the Central Committee, Politburo, Secretariat related to handling violations of population policy and proactively amending Guideline 05-HD/TW, dated November 22, 2022, of the Central Inspection Committee in the direction not to impose disciplinary action in cases of having a third child, and not to retroactively apply disciplinary measures already taken.

Task the Communist Party delegation to the Government of Vietnam, and the Communist Party delegation to the Central Public Security to direct the urgent completion of building, synchronizing data on human resources (based on the national database on population) to accurately assess the population fluctuation (in terms of both quantity and quality) for precise, prompt, and effective planning and implementation of forthcoming population policies.

Currently, Article 10 of Ordinance 06/2003/PL-UBTVQH11 (amended by Ordinance 08/2008/UBTVQH12) stipulates each couple to have 1 to 2 children as follows:

The rights and obligations of each couple and individual in implementing the population campaign and family planning, reproductive health care:

- Decide the time and spacing of births;

- Have one or two children, except in special cases as prescribed by the Government of Vietnam;

- Protect health, implement measures to prevent reproductive tract infections, sexually transmitted diseases, HIV/AIDS, and fulfill other obligations related to reproductive health.
