Regarding this issue, LawNet would like to answer as follows:
On March 6, 2024, the Government Office issued Notice 81/TB-VPCP, concluding the Deputy Prime Minister Tran Luu Quang's remarks at the first session of the Steering Committee for the implementation of the arrangement of district-level and commune-level administrative units for the period 2023–2030.
The Plan for the arrangement of district-level and commune-level administrative units in 2024 will be issued. The rearrangement of administrative units is a significant but complex task that has a major impact on the psychology of the people and the personnel, officials, and workers involved in the rearrangement.
Accordingly, during the implementation process, Deputy Prime Minister Tran Luu Quang requested ministries, sectors, localities, and relevant agencies to fully implement the guiding principles stated in the Resolutions, Conclusions of the Politburo, Resolutions of the Standing Committee of the National Assembly, Government, and Official Dispatches of the Prime Minister. They need to focus on implementing specific tasks in the coming time, such as:
-The Ministry of Home Affairs, the Standing Office of the Steering Committee, proactively guides and urges localities; establishes mechanisms to receive information from localities; consolidates implementation results, difficulties, and obstacles; and promptly reports to the Head of the Steering Committee and relevant members of the Steering Committee for handling and resolving them in the shortest and most effective time. The Minister of Home Affairs will coordinate the synthesis and absorption of opinions discussed at this meeting, complete and sign the Report on the implementation of the arrangement of district-level and commune-level administrative units for the period 2023–2030;
The Head of the Steering Committee will review and issue the Plan for implementing the tasks of rearranging district-level and commune-level administrative units in 2024, and assign members of the Steering Committee to be in charge of specific areas for implementation; chair and coordinate relevant ministries and sectors to organize the appraisal of project documents of localities, prioritizing localities with a small number of administrative units to be rearranged that have completed the project early compared to the required deadline; and group localities to submit project documents in batches, avoiding concentration at one point in time.
-The Ministry of Planning and Investment will study and propose solutions to resolve difficulties for 10 localities that had provincial planning approved before Resolution 35/2023/UBTVQH15 was issued; according to their assigned functions and tasks, provide guidance to localities on budget allocation for the implementation of the arrangement of administrative units as prescribed in Resolution 35/2023/UBTVQH15.
-The Ministry of Finance urgently submits to the Government a decree to replace Decree No. 167/2017/ND-CP and Decree No. 67/2021/ND-CP, which regulate the rearrangement and handling of state assets (including the addition of district-level and commune-level administrative units undergoing rearrangement) by the end of the first quarter of 2024; provide guidance on budget estimation, utilization, and settlement of funds for the implementation of the arrangement of district-level and commune-level administrative units as prescribed.
-The Ministry of Construction takes the lead and coordinates with the Ministry of Home Affairs and localities to resolve obstacles in urban planning and classification work to ensure the construction progress and submission of project documents by localities no later than September 2024, following the direction of the Prime Minister.
-Central ministries and agencies, based on the recommendations and proposals of localities, promptly resolve obstacles and difficulties in the organization and implementation of the arrangement of district-level and commune-level administrative units. The Ministry of Home Affairs is responsible for summarizing the obstacles and difficulties of localities and submitting them to central ministries and agencies for consideration and resolution according to their authority or submitting them to higher-level authorities for consideration.
-Members of the Steering Committee assigned to specific areas need to enhance their responsibilities, closely follow the implementation situation in localities to ensure the completion of the arrangement of administrative units by September 2024.
The Ministry of Home Affairs will assign professional officials to assist the members of the Steering Committee in conducting surveys and working with the localities they are assigned to.
