The Plan for implementation of the Law on Telecommunications in Vietnam (Internet image) 

Regarding this matter, LawNet would like to answer as follows: 

On April 4, 2024, the Prime Minister issued Decision 278/QD-TTg on the Plan for implementation of the Law on Telecommunications in Vietnam dated November 24, 2023.

The Plan for implementation of the Law on Telecommunications in Vietnam

The Plan includes the following:

(1) Organizing the review of legislative documents

- Content: reviewing legislative documents related to the Law within the delegated jurisdiction of the state management authority; implementing timely revisions, supplements, replacements, annulments, or new promulgations of legislative documents to ensure compliance with the provisions of the Law and detailed regulations under the Law.

- Implementing agency: The Ministry of Information and Communications will review legislative documents related to the Law within its delegated jurisdiction; ministries, ministerial-level agencies, and Provincial People's Committees of centrally-run provinces and cities will review legislative documents related to the Law within their respective fields and areas of state management and submit the review results to the Ministry of Information and Communications for consolidation and reporting to the Prime Minister.

- Deadline: December 2024.

(2) Forming legislative documents detailing the Law

- Decree detailing certain provisions and measures for implementing the Law on Telecommunications 2023.

+ Leading agency: Ministry of Information and Communications.

+ Coordinating agencies: Government Office, Ministry of Justice, relevant ministries, ministerial-level agencies, Provincial People's Committees of centrally-run provinces and cities, and related organizations and agencies.

+ Deadline for submission: April 15, 2024.

- Decree detailing certain provisions of the Law on Telecommunications 2023 on managing telecommunications resources, internet resources; compensation for the state when recovering telecommunications codes, resources, and internet resources; auctioning the right to use telecommunications codes, national domain names ".vn".

+ Leading agency: Ministry of Information and Communications.

+ Coordinating agencies: Government Office, Ministry of Justice, relevant ministries, ministerial-level agencies, Provincial People's Committees of centrally-run provinces and cities, and related organizations and agencies.

+ Deadline for submission: April 15, 2024.

- Decree detailing the Law on Telecommunications 2023 on public telecommunications activities.

+ Leading agency: Ministry of Information and Communications.

+ Coordinating agencies: Government Office, Ministry of Justice, relevant ministries, ministerial-level agencies, Provincial People's Committees of centrally-run provinces and cities, and related organizations and agencies.

+ Deadline for submission: April 15, 2024.

- Circular of the Minister of Information and Communications detailing wholesale activities in telecommunications.

+ Leading agency: Ministry of Information and Communications.

+ Coordinating agencies: relevant organizations and agencies.

+ Deadline for issuance and effectiveness: before July 1, 2024.

- Circular of the Minister of Information and Communications detailing the mechanism, principles of price control, methods of pricing for the use of cable networks within buildings, and rental prices for passive telecommunications infrastructure among telecommunications enterprises, organizations, and individuals owning telecommunications works.

+ Leading agency: Ministry of Information and Communications.

+ Coordinating agencies: Ministry of Construction, Ministry of Finance, and relevant organizations and agencies.

+ Deadline for issuance and effectiveness: before July 1, 2024.

- Ministers, heads of ministerial-level agencies will review the provisions of the Law and related regulations within the scope of their assigned tasks and powers to issue legislative documents within their jurisdiction or submit them to competent authorities for the issuance of legislative documents to ensure the consistency and uniformity of provisions.

Implementation period: Annually.

(3) Legal dissemination, popularization, and education on telecommunications

- Activities include:

+ Posting, updating the full text of the law and detailed regulations on the Portal/Electronic Information Page, the national database of legislative documents, and other suitable forms for easy access, exploitation, and use by officials, public employees, and the public.

+ Implementing appropriate forms of legal popularization; compiling, posting, and widely distributing popularization materials, and coordinating with the Ministry of Justice (Department of Popularization and Legal Education) to update the national Portal of Legal Popularization and Education at http://pbgdpl.gov.vn.

+ Organizing dissemination, popularization, and legal education on telecommunications through specific forms; coordinating with media agencies to implement sections, programs, news, articles, and other forms as stipulated by laws on legal popularization and education, suitable for specific target groups.

- Implementing agencies: Ministry of Information and Communications, Ministry of Justice, Voice of Vietnam, Vietnam Television, Vietnam News Agency, and other press, radio, and television agencies.

- Coordinating agencies: relevant ministries, ministerial-level agencies, government agencies, Provincial People's Committees of centrally-run provinces and cities, and related organizations and agencies.

- Implementation period: 2024 and subsequent years.

(4) The Ministry of Information and Communications, ministries, ministerial-level agencies, and People's Committees of provinces and centrally run cities review and implement state management tasks assigned in the Law according to fields and areas within the scope of assigned tasks and powers.

Implementation time: annually.
