Recently, the Government of Vietnam issued Decree 10/2012/ND-CP detailing the implementation of judicial education measures at commune, ward, and commune-level town levels for juvenile offenders in Vietnam.
The People's Committees at all levels shall direct the Implementation of Educational Measures at the Commune/Ward Level (Internet image)
According to Article 16 of Decree 10/2012/ND-CP which stipulates the responsibilities of the provincial People’s Committees in organizing the implementation of educational measures at the commune level for juvenile offenders. To be specific:
- Direct and inspect the implementation of educational measures at the commune level for juvenile offenders within their local management. Develop plans to assign tasks to different levels of government, agencies, departments, social organizations, and mass associations in executing educational measures at the commune level; attend to spiritual life, provide material assistance, ensure the proper implementation of child rights, and assist the educated in reintegrating into the community.
- Direct the organization of communication, dissemination, and legal education concerning educational measures at the commune level for juvenile offenders; disseminate experiences, and exemplary models in sentencing execution, supervision, education, and assistance for the educated.
- Allocate the provincial budget as per the provisions of the Law on the State Budget; direct and guide subordinate agencies, units, and the lower-level People's Committees in managing and utilizing funds for implementing educational measures at the commune level for juvenile offenders according to legal regulations.
In addition, the responsibilities of the district-level People’s Committees in organizing the implementation of educational measures at the commune level for juvenile offenders are stipulated as follows:
- Direct, guide, and check the commune-level People’s Committees, departments, agencies, social organizations, mass associations, and related agencies and organizations in implementing educational measures at the commune level for juvenile offenders; guide, inspect, and urge the reception, management, education, and assistance of the educated within their local management, and prevent recidivism and legal violations.
- Allocate the district budget as per the provisions of the Law on the State Budget; direct and guide subordinate agencies, units, and the commune-level People’s Committees in managing and utilizing funds for implementing educational measures at the commune level for juvenile offenders according to legal regulations.
