Recently, the Ministry of Justice has issued Circular 17/2011/TT-BTP providing guidance on the provisions of the Law on Lawyers and the Decree guiding the Law on Lawyers concerning the socio-professional organization of lawyers in Vietnam.
The operation registration certificate of a law-practicing organization shall be withdrawn in the following cases in Vietnam (Internet image)
According to Article 11 of Circular 17/2011/TT-BTP, the operation registration certificate of a law-practicing organization or its branches in Vietnam shall be withdrawn when:
- Termination of activities as prescribed in Clause 1, Article 47 of the Law on Lawyers;
- The law-practicing organization suspends its activities for more than one year from the time recorded in the report on the suspension of activities of that organization without a report on the extension of the suspension of activities.
In case the law-practicing organization's Certificate of Operation Registration is revoked according to Point b, Clause 1 of this Article, the Department of Justice is responsible for carrying out the procedures for terminating the activities of the law-practicing organization as prescribed in Clause 3, Article 47 of the Law on Lawyers.
The Certificate of Operation Registration of the branch of a law-practicing organization will be revoked as prescribed in Clause 1, Article 48 of the Law on Lawyers.
When revoking the Certificate of Operation Registration of the law-practicing organization or its branch, the Department of Justice where the organization is registered will issue a decision to revoke the Certificate of Operation Registration of the law-practicing organization or its branch and send it to the Bar Association and the tax authority where the organization is registered.
