The National Assembly of Vietnam adopts the Law on Amendments to Law on Cooperatives

(Chinhphu.vn) - With an overwhelming majority of National Assembly deputies in favor (93.44%), on the morning of June 20, the National Assembly of Vietnam voted to adopt the Law on Amendments to Law on Cooperatives.

The Law on Amendments to Law on Cooperatives in Vietnam was adopted with a structure consisting of 7 chapters and 115 articles, stipulating the establishment, management organization, reorganization, dissolution, bankruptcy, and related activities of artels, cooperatives, and cooperative unions; state policies regarding the development of artels, cooperatives, and cooperative unions.

The subjects of application of the Law include: artels, cooperatives, and cooperative unions. Members of artels, cooperatives, and cooperative unions. Agencies, organizations, and individuals related to the establishment, management organization, reorganization, dissolution, bankruptcy, and related activities of artels, cooperatives, and cooperative unions.

The Law on Amendments to Law on Cooperatives clearly stipulates the rights of cooperatives and cooperative unions as follows: Effectively execute the set objectives and targets; make decisions on the organization, management, and activities of cooperatives and cooperative unions; hire and utilize labor; engage in production and business activities in legal sectors and occupations; require members to register the need for products and services to build and implement plans for providing and consuming products and services on behalf of members, provide products and services outside after fulfilling obligations and ensuring the benefits of members according to the charter or related law; offer services, conduct economic, social, and cultural activities aimed at improving the lives of members, the community, and ensuring sustainable development;

participate in implementing policies, programs, and projects for economic, cultural, and social development; ensure political security, social order, safety, and environmental protection within the community. Admit new members, and terminate membership status according to the law on cooperatives; form alliances and cooperate with domestic and international organizations and individuals to implement the objectives of cooperatives and cooperative unions; contribute capital, purchase shares, and establish enterprises to support the activities of cooperatives and cooperative unions; distribute income and manage losses and debts of cooperatives and cooperative unions...

Regarding land policies, according to the Law: In the land use planning and plans, local authorities prioritize allocating land funds for artels, cooperatives, and cooperative unions to lease; provide reasonable incentives in terms of price and lease duration for artels, cooperatives, and cooperative unions that have not been supported in land leasing according to the law on land and related law.

Artels, cooperatives, and cooperative unions leasing land and water surface land from the State for production and business purposes are exempted or reduced from land rent and water surface land rent; in cases of leasing, or subleasing land and water surface land from organizations, households, and individuals for production and business purposes, they are supported by the State with land rent and water surface land rent according to the law on land.

The State facilitates artels, cooperatives, and cooperative unions to use land stably for production and business activities according to the law on land.

The Law clearly stipulates the rights of cooperative members: Receive products, services, or job provision from cooperatives. Distribution of income according to this Law and the Charter. Enjoy the benefits of cooperative welfare. Participate in or elect delegates to attend the General Assembly of members. Vote on matters within the General Assembly's authority. Nominate and propose members of the board of directors, directors (general directors), supervisory board members, or supervisors, and other elected management positions. Access necessary information related to the cooperative’s activities. Receive support in training, fostering, and improving professional skills to serve the cooperative’s activities. Withdraw from the cooperative according to this Law and the Charter...

The Law on Amendments to Law on Cooperatives also specifies cases of termination of official membership, including: Members cease to exist, dissolve, or go bankrupt. cooperative unions cease to exist, dissolve, or go bankrupt. Members voluntarily withdraw from the union of cooperatives. Members are expelled according to the Charter's provisions. Members do not use products, services, or do not contribute labor continuously as stipulated by the Charter;...

Regarding the responsibilities of state management agencies, The Law on Amendments to Law on Cooperatives clearly states that the Government of Vietnam uniformly manages the state regarding artels, cooperatives, and cooperative unions nationwide. The Ministry of Planning and Investment assists the Government of Vietnam in performing state management tasks of artels, cooperatives, and cooperative unions. Ministries and ministerial-level agencies, within their tasks and powers, are responsible for state management of artels, cooperatives, and cooperative unions under the law. People's Committees at all levels manage the state regarding artels, cooperatives, and cooperative unions according to their authority, implementing measures for developing artels, cooperatives, and cooperative unions within the local socio-economic development programs...
