Regarding this issue, LawNet would like to answer as follows:
On January 4, 2024, the Ministry of Labor, War Invalids, and Social Affairs issued Official Dispatch 41/LDTBXH-NCC on instructions for gift giving by the President on the occasion of the Lunar New Year Giap Thin 2024.
To implement Decision 1583/QD-CTN of the President in 2023 on giving gifts to a number of people with meritorious services to the revolution on the occasion of the Lunar New Year Giap Thin in 2024 (enclosed), the Ministry of Labor, War Invalids, and Social Affairs provides additional guidance as follows:
(1) Subjects specified in Clause 1 and Point a of Clause 2 of Article 1 of Decision 1583/QD-CTN:
Each person only receives 01 gift from the President. In the event that a person is confirmed to be eligible for two or more gift levels, he or she will receive 01 gift with the highest level. If eligible for the same gift level, he or she will receive 01 gift with that level.
(2) Subjects specified in Point b, Clause 2, Article 1 of Decision 1583/QD-CTN:
- The representative of the martyrs' relatives is the only person among all the martyrs' living relatives who will receive 01 gift. If the representative of a martyr's relative is also the recipient of a gift as prescribed in Clause 1 and Point a of Clause 2 Article 1 of Decision 1583/QD-CTN, then appoint a representative of the remaining relatives of the martyr to receive 01 gift for the representative of the martyr's relatives.
- In case a martyr's relative has only one survivor and that sole representative is subject to gift giving according to the provisions of Point a, Clause 1, and Point a, Clause 2, Article 1 of Decision 1583/QD-CTN, that person will receive 01 additional gift for the representative of the martyr's family.
- In cases where relatives of martyrs have 2 or more survivors, they are eligible to give gifts according to the provisions of Point a, Clause 1, and Point a, Clause 2 of Article 1 of Decision 1583/QD-CTN, then nominate one person to receive 01 gift for the representative of the martyr's family.
- Subjects specified in Point c, Clause 2, Article 1 of Decision 1583/QD-CTN:
In the event that a martyr has no relatives, the martyr's worshiper will receive a gift from the President. For each martyr, the martyr's worshiper will receive 01 gift.
According to Decision 1583/QD-CTN in 2023, the President decided to give gifts to a number of people with meritorious services to the revolution on the occasion of the Lunar New Year Giap Thin in 2024, with 02 specific gift levels as follows:
(1) Gift amount of 600,000 VND:
- People with meritorious services to the revolution:
+ People who participated in the revolution before January 1, 1945, are receiving preferential monthly benefits.
+ People who participated in revolutionary activities from January 1, 1945, to the August uprising in 1945 are receiving preferential monthly benefits.
+ Vietnamese Heroic Mothers are receiving preferential monthly benefits.
+ Heroes of the People's Armed Forces and Labor Heroes during the resistance period are receiving preferential monthly benefits.
+ War invalids, policy beneficiaries such as war invalids, class B war invalids, and sick soldiers with a physical injury rate of 81% or more are receiving preferential monthly benefits.
+ Resistance activists infected with toxic chemicals with a bodily injury rate of 81% or more are receiving preferential monthly benefits.
+ People who have contributed to helping the revolution are receiving a monthly maintenance allowance.
- Relatives of martyrs are receiving monthly survivor benefits; relatives of two or more martyrs are receiving monthly death benefits.
(2) Gift amount of 300,000 VND:
- People with meritorious services to the revolution:
+ Wounded soldiers, policy beneficiaries such as war invalids, class B war invalids, and sick soldiers with a physical injury rate of 80% or less are receiving preferential monthly benefits. War invalids are receiving disability benefits.
+ Resistance activists infected with toxic chemicals with a bodily injury rate of 80% or less are receiving preferential monthly benefits.
+ People who participate in revolutionary activities, resistance wars, defend the Fatherland, or perform international duties and are imprisoned or exiled by the enemy are receiving preferential monthly benefits.
+ People who have contributed to helping the revolution are receiving preferential monthly benefits.
- Representative of martyrs' relatives.
- People who worship martyrs (in cases where martyrs have no relatives).
