The Ministry of Information and Communications of Vietnam's guidelines for the implementation of the National Data Strategy

On February 2, 2024, the Prime Minister of Vietnam issued Decision 142/QD-TTg approving the National Data Strategy until 2030.

To ensure the synchronized and effective implementation of Decision 142/QD-TTg nationwide, the Ministry of Information and Communications provides guidance to ministries, ministerial agencies, government agencies, People's Committees of provinces, and centrally-run cities on the tasks and key solutions to be implemented by 2030. The details are specified in the accompanying appendices (Appendix I - for ministries, ministerial agencies, and government agencies; Appendix II - for provinces, centrally governed cities; Appendix III - Framework for developing data strategies for localities).

Based on this guiding framework, depending on the conditions, characteristics, and specific situations at the ministry, central authorities, and local authorities, the respective agencies are requested to specify and supplement the tasks and implementation solutions accordingly.

It is respectfully requested that the ministries and central authorities, based on the specific assigned tasks in Decision 142/QD-TTg, promptly organize the implementation of the Strategy, publish the list of open data and big data of their respective sectors, coordinate with localities in developing open data and big data of their sectors; develop and issue their own data strategies, or integrate content on data development into the annual digital transformation projects and plans of the ministries and central authorities for synchronized implementation with the National Data Strategy. Additionally, they are requested to send the relevant information to the Ministry of Information and Communications (Institute of Information and Communication Strategy) for monitoring and synthesis.

It is respectfully requested that the People's Committees of provinces, centrally-run cities, based on the specific situation of each locality, decide on the construction and issuance of separate plans/strategies for implementing the National Data Strategy or integrate content on data development into the strategies, projects, and annual digital transformation plans of the provinces and cities based on detailed elaboration of the solutions and tasks of the National Data Strategy, in coordination with the publication plans for data development of the managing ministries and central authorities, and in accordance with the conditions, needs, and development orientations of the localities; send the relevant information to the Ministry of Information and Communications (Institute of Information and Communication Strategy) for monitoring and synthesis.

During the implementation process, if there are difficulties, obstacles, or new issues, it is kindly requested that the ministries, central authorities, and localities provide feedback to the Ministry of Information and Communications for review, additional guidance, and supplementation.

Development of the institution and policies for the National Data Strategy until 2030 in Vietnam

According to Decision 142/QD-TTg in 2024, the tasks for developing the institution and policies for the National Data Strategy until 2030 in Vietnam are as follows:

- Focus on researching and developing the Law on Digital Industry, which regulates data ownership forms, data property rights, and data trading policies, transforms data into a legally protected asset, and creates a data market.

- Develop decrees on e-transactions in state agencies and the information system serving e-transactions, decrees on electronic signatures and trusted services, and decrees on the national database catalog.

- Develop decrees on the purchase and exchange of private data, and copyright data to create a data market; regulations on the types of data eligible for buying, exchanging, and transferring.

- Establish regulations on the obligations and responsibilities of operating units in the digital platform, e-transaction system in terms of data collection, storage, usage, connection, sharing, and transaction.

- Develop regulations on standards, criteria, storage and sharing databases, and regulations on non-identifiable data. Issue guidelines related to data quality management.

- Build a Data Governance Framework, data architecture, and data dictionaries, and add them to the subsequent versions of the Vietnam e-Government Architecture Framework.

- Research and develop incentive policies to promote the development of enterprises operating in the data field, provide data management strategy consultation, provide platforms and data management services, and prevent the dominance and manipulation of the market by organizations and enterprises holding a large amount of data in Vietnam.

- Establish and issue principles for responsible data usage and guidelines on safety when applying artificial intelligence (AI) in the public sector to maintain comprehensive human control in all AI applications, harmonizing the benefits that AI brings to sectors in all aspects of social life, while ensuring appropriate access to AI in accordance with human ethical standards.
