Regarding this issue, LawNet would like to answer as follows:

On November 20, 2023, the Central Emulation and Commendation Committee issued Official Dispatch 3385/BTDKT-P.II, providing professional guidance on emulation and commendation work.

The Ministry of Home Affairs to provide professional guidance on emulation and commendation work in Vietnam

On September 5, 2023, the Minister of Home Affairs issued Official Dispatch 5007/BNV-TDKT on improving the quality of emulation and commendation work. After promulgation, a number of ministries, branches, and provinces requested guidance on the operations contained in the above document.

Based on feedback and requests for guidance from a number of ministries, branches, and provinces, the Central Emulation and Commendation Committee provides guidance on 02 professional contents as follows:

Content 1: At point c, section III.5, Official Dispatch 5007/BNV-TDKT “An initiative can only be used once as a standard for recommending a reward. An initiative that has been used when considering emulation titles cannot be used when considering the form of reward, and vice versa. Do not use one initiative to consider many forms of reward."

Content 2: At point g, section III.6 Official Dispatch 5007/BNV-TDKT "Evidencing documents in the reward application file must be originals or certified copies of competent authorities."

For example, the Central Emulation and Commendation Committee guides the implementation of Content 1 as follows:

(1) Consideration and recognition of initiatives:

According to Decree 13/2012/ND-CP promulgating the Initiative Charter and Circular 18/2013/TT-BKHCN guiding the implementation of a number of provisions of the Initiative Charter, if an initiative has been recognized at a facility, that facility will not recognize this initiative again.

For example: A has an initiative recognized in 2017 at facility X, then from 2018 onwards, facility

According to Decree 91/2017/ND-CP detailing the implementation of a number of articles of the Law on Emulation and Commendation, initiatives must be applied practically with high efficiency and considered by the Initiative Council. The leader recognizes the scope of influence at each level (grassroots level is considered by the Grassroots Initiative Council and recognized by the leader; at the ministerial, branch, and provincial levels, reviewed by the Ministerial, branch, and provincial Initiative Council and recognized by the head; national level by the Council for Initiatives at the ministerial, branch, and provincial levels, reviewed and recognized by the head).

Thus, an initiative is only recognized once in one area of influence at each level. On the other hand, initiative is an achievement; only when recognized by competent authorities can it meet the conditions and standards for consideration and reward.

(2) Criteria for considering emulation titles and forms of reward

- Standard initiatives included in emulation titles include: grassroots emulation soldier; emulation soldier at ministerial, branch, and provincial levels; and national emulation soldier—all three of these emulation titles are based on the basis of grassroots emulation soldier.

According to current legal regulations on emulation and commendation, one of the standards for grassroots emulation soldiers is "fulfilling tasks well" and "having recognized initiatives." and must be applied in practice to achieve high efficiency and have a scope of influence at the grassroots level or equivalent (for the armed forces)".

- Initiatives as standards in the form of rewards include: Certificates of Merit and Medals all take the criteria of "excellent completion of tasks" and "having recognized initiatives...". Certificates of merit at the ministerial, branch, and provincial levels are the foundation for higher rewards.

One of the criteria for awarding "Certificates of Merit at the ministerial, branch, and provincial levels to individuals is "having 02 years or more of continuously successfully completing tasks; during that time, two initiatives were recognized and applied effectively at the grassroots level." "Prime Minister's Certificate of Merit" for an individual means "having been awarded a certificate of merit at the ministerial, branch, or provincial level and for the next 5 years or more for continuously completing outstanding tasks; during that time, 05 initiatives were recognized and applied effectively at the grassroots level."

Thus, initiatives that are recognized and applied effectively at the grassroots level during the reward proposal stage ensure the correct conditions and standards for awarding certificates of merit at the ministerial, branch, and provincial levels.
or a Certificate of Merit from the Prime Minister.

For example: In 2017, when considering awarding "Certificates of Merit at ministerial, sectoral and provincial levels", grassroots initiatives recognized for 2 years or more from 2017 or earlier will ensure the standards for considering certificates of merit at ministerial, sectoral, and provincial levels.

In case of consideration for awarding a "Certificate of Merit from the Prime Minister" if in 2017 a certificate of merit was awarded at the ministerial, branch, and provincial levels in the period 2016–2017, only grassroots initiatives recognized from 2018 onwards will ensure consideration standards, while grassroots initiatives recognized before 2018 do not ensure standard conditions for consideration of the Prime Minister's Certificate of Merit.

For the Medal consideration criteria, you must have received a form of commendation consecutively and for the next 5 years or more for continuously successfully completing tasks, during which time there have been a number of initiatives according to the scope of the recognition level.

Individuals who "complete their tasks well" do not meet the conditions and standards for consideration of forms of reward from certificates of merit at ministerial, branch, provincial, or higher levels. On the other hand, initiative is a recognized achievement, so it must ensure the reward principle "Do not reward many forms for one achievement" specified in Clause 2, Article 3 of Decree 91/2017/ND-CP.

In summary, one of the criteria for considering emulation titles and forms of reward for individuals is the level of task completion, and having initiatives that are recognized for their scope of influence at each level within the time of considering performance and reward will be counted as a reward standard.

According to current law, an individual can only be ranked one level per year: "excellently completed task" or "completed task well".

Therefore, if emulation titles are recognized, when considering awarding forms of commendation from ministerial, branch, provincial, or higher-level certificates of merit, the standards will not be met, and vice versa.
