Regarding this issue, LawNet would like to answer as follows:

On October 2, 2023, the Ministry of Finance issued Official Dispatch 10534/BTC-QLCS on the implementation of Decree 72/2023/ND-CP dated September 26, 2023, of the Government regulating standards and norms for automobile use.

Specifically, on September 26, 2023, the Government issued Decree 72/2023/ND-CP regulating standards and norms for automobile use. (replacing Decree 04/2019/ND-CP dated January 11, 2019 of the Government). Decree 72/2023/ND-CP takes effect on November 10, 2023.

The Decree specifically stipulates standards and norms for automobile use, a fixed budget for automobile use, renting a automobile service, and rearrangement and handling of automobiles.

The Decree does not assign the Ministry of Finance to detail regulations but is the agency responsible for developing and organizing the implementation of legal documents regulating the management and use of public assets. Therefore, the Ministry of Finance requests that your agencies pay attention to leading, directing, and organizing the implementation of determining standards and norms for automobile use, purchasing, equipping, managing, and using automobiles. automobiles according to standards and norms, handling and liquidation of surplus automobiles, and other tasks specified in Decree 72/2023/ND-CP.

In particular, note some of the following contents:

(1) The quantity and purchase price of automobiles specified in Decree 72/2023/ND-CP are the maximum quantity and price. Based on the actual need to use automobiles to perform assigned tasks and sources of asset formation at agencies, organizations, units, state-owned enterprises, and funding sources for procurement (state budget allocation, state budget support, the public service development fund of public service units, and other funding sources allowed to be used according to the provisions of law), agencies and persons with authority to decide on delivery, transfer, and procurement shall consider and decide on the appropriate quantity and purchase price of vehicles, ensuring savings and efficiency.

(2) Determine standards and norms for using automobiles to serve positions in Section 1 Chapter II Decree 72/2023/ND-CP according to the subjects specified in Serial numbers I, II, III, IV, V List of titles, leadership positions, and equivalents of the political system from central to grassroots level, issued together with Conclusion No. 35-KL/TW dated May 5, 2022 of the Politburo and regulations in Article 4, Article 5, Article 6, Article 7 of Decree 72/2023/ND-CP.

Positions not included in the list specified in ordinal numbers I, II, III, IV, V List of titles, leadership positions and equivalents of the political system from central to grassroots level issued together with Conclusion No. 35-KL/TW dated May 5, 2022 of the Politburo has been equipped with official automobiles as prescribed in Decree 04/2019/ND-CP shall continue to use it according to the provisions of Clause 2, Article 25 of Decree 72/2023/ND-CP (such as: The deputy in charge will receive the same salary or allowance coefficient as the chief) (Deputy Head of the National Assembly Delegation in charge,...), Member of the Standing Committee of the Hanoi Party Committee, Ho Chi Minh City Party Committee; Deputy Head of the National Assembly Delegation in charge of Hanoi and Ho Chi Minh City; Chairman of the Fatherland Front in Hanoi, Ho Chi Minh City...).

(3) Determine standards and norms for using automobiles for general work in Section 2, Chapter II, Decree 72/2023/ND-CP. In there:

- Subjects allowed to use automobiles for general work purposes are determined according to regulations in serial numbers VI, VII, VIII List of titles, leadership positions, and equivalents of the political system from central to grassroots level, issued together with Conclusion No. 35-KL/TW dated May 5, 2022, of the Politburo and provisions in Clauses 2 and 3 of Article 8 of Decree 72/2023/ND-CP.

- For current positions not included in the list mentioned in Point 3.1 of this section, the allowance coefficients are equivalent to the position allowance coefficients of the positions prescribed in Points a, b, c, d, and dd, Clause 2, Article 8 of Decree 72/2023/ND-CP (such as: Full-time National Assembly Delegates, etc.), then comply with the provisions in Clause 3 of Article 25 of Decree 72/2023/ND-CP.
