Regarding this issue, LawNet would like to answer as follows:

The Ministry of Science and Technology issued Decision 2060/QD-BKHCN on the announcement of newly issued administrative procedures and abolished administrative procedures in the field of intellectual property within the scope of management functions of the Ministry of Science and Technology.

The list of administrative procedures to be annulled in the field of intellectual property in Vietnam

From September 13, 2023, 28 central-level administrative procedures and 02 provincial-level administrative procedures in the field of intellectual property within the scope of management functions of the Ministry of Science and Technology have been announced in Decision 3675/QD-BKHCN will be abolished.

As follows:

(1) Central level administrative procedures

- Patent registration procedures under the PCT Treaty with Vietnam selected

- Patent registration procedures under the PCT Treaty originating in Vietnam

- Procedures for international registration of trademarks of Vietnamese origin

- Procedures for international registration of trademarks with Vietnamese designation

- Procedures for amending, supplementing and separating industrial property registration applications

- Procedures for requesting recording of transfer of industrial property registration applications

- Procedures for maintaining the validity of Patent Protection Certificates

- Procedures for extending the validity of the Certificate of Protection

- Procedures for granting copies of protection titles and reissuing protection titles/duplicates of protection titles

- Procedures for registering industrial property transfer contracts

- Procedures for registration of contracts for transfer of rights to use industrial property objects

- Procedures for recording content modifications, extensions, and premature termination of contracts for the transfer of rights to use industrial property objects

- Procedures for making decisions on compulsory licensing of inventions

- Procedures for requesting termination of patent use rights according to mandatory decisions

- Procedures for terminating the validity of protection titles

- Procedures for invalidating protection titles

- Procedures for amending the Certificate of Protection

- Procedures for registering for the industrial property representation professional examination

- Procedures for issuance of industrial property representation service practice certificate

- Procedures for reissuance of industrial property representation service practice certificate

- Procedures for recognition of industrial property representatives

- Procedures for recognition of industrial property representation service organizations

- Procedures for recording changes in industrial property representation service organizations/industrial property representatives

- Procedures for registering for industrial property appraisal examination

- Procedures for issuance of industrial property assessor card

- Procedures for re-issuance of industrial property assessor card

- Procedures for issuance of Certificate of eligibility for industrial property appraisal activities

- Procedures for reissuance of Certificate of eligibility for industrial property appraisal activities

(2) Provincial administrative procedures

- Procedures for issuance of Certificate of eligibility for industrial property appraisal activities

- Procedures for reissuance of Certificate of eligibility for industrial property appraisal activities

In addition, Decision 2060/QD-BKHCN also promulgates 40 new central-level administrative procedures and 03 provincial-level administrative procedures specified in the Law on Intellectual Property No. 50/2005/QH11, amended according to Law No. 36/2009/QH12, Law No. 42/2019/QH14, and Law No. 07/2022/QH15, Decree 65/2023/ND-CP detailing a number of articles and measures to implement the Law on Intellectual Property on industrial property, protection of industrial property rights, rights to plant varieties, and state management of intellectual property.
