On August 03, 2024, the Government of Vietnam issued Resolution 118/NQ-CP regarding the Specialized Legislative Session of July 2024.

The Government of Vietnam's comments on the draft Employment Law (amended) 

The Government of Vietnam appreciates the serious and active preparation of the Ministry of Labor, Invalids, and Social Affairs in building and completing the dossier of the draft Employment Law (amended) in accordance with the Law on promulgation of legislative documents. It agrees on the necessity to develop the draft Employment Law (amended) to fully institutionalize the directives of the Communist Party and the State, meet the requirements for the quality of human resources, especially high-quality labor with skills and social knowledge; ensure the continuity between various forms, levels, and fields of education and training, aligned with sustainable development goals; build and develop a labor market that is interconnected and internationally integrated; promptly, flexibly, and effectively address policies for workers and enterprises; enhance the capacity of state management agencies and mobilize societal resources and creativity based on existing strengths.

To complete the draft Law, the Government of Vietnam requests the Ministry of Labor, Invalids, and Social Affairs to undertake the following tasks:

- Continue to summarize, review, and evaluate to ensure the draft Law's feasibility, thoroughly addressing difficulties and obstacles in implementing legal provisions on employment, ensuring consistency and synchronization with laws in related fields. It is essential to closely follow the policies, orientations, and strategies of the Communist Party and the State on developing human resources in a flexible and modern manner, meeting domestic and global development trends, especially in the digital, high-tech environment, adapting to Vietnam's aging population rate;

- Organize effective consultation activities, gather feedback from impacted groups, experts, enterprises, foundational agencies, and organizations; simultaneously, ensure appropriate communication activities on new policies and content affecting a large number of workers and businesses to ensure the draft Law's feasibility and create societal consensus among the public, relevant agencies, organizations, and directly affected entities;

- Chair and closely coordinate with related ministries and agencies to research and maximally incorporate the opinions of Government Members to provide suitable regulations, ensuring a full legal basis and practicability of provisions on labor registration and management; support, create sustainable and satisfactory jobs for non-contractual labor; favorable loan policies tied to conditions, processes, procedures; extend support for loan beneficiaries and participants in unemployment insurance; model the National Employment Fund; regulate working time limits for students. The draft Law's content must align with the policy groups already approved by the Government of Vietnam; ensure maximal decentralization and delegation in state management; simplify and modernize administrative procedures; promote digital transformation; avoid creating exploitative mechanisms; prevent and combat corruption and negative behaviors in the labor and employment sector; enhance the effectiveness of labor market supply-demand connections;

- Urgently gather and fully address the opinions of Government Members and conclusions of the Government of Vietnam to complete the dossier of the draft Law, ensuring quality and progress.

Deputy Prime Minister of Vietnam - Le Thanh Long is assigned to direct the completion of this Law project, submitting it to the National Assembly for consideration and comments at the 8th Session (October 2024).
