On September 25, 2020, Hanoi issued Decree 115/2020/ND-CP on the recruitment, employment, and management of public employees.
The criteria for applying for consideration for the rank promotion to professional titles of Vietnamese public employees (Illustrative Image )
Accordingly, Article 32 of Decree 115/2020/ND-CP stipulates that public employees can register to take the exam or consideration for the rank promotion to a higher adjacent professional title when they meet the following standards and conditions:
Firstly, they must be graded at the completion of tasks well or above in the year immediately preceding the year they take the exam or consideration for the rank promotion to professional titles. They must possess good political qualities and professional ethics, not be under any disciplinary action period, and not be in the process of implementing regulations related to the discipline of public employees as prescribed in Article 56 of the Law on Public Employees, as amended and supplemented in Clause 8, Article 2 of the Law amending and supplementing a number of articles of the Law on Officials and the Law on Public Employees.
Secondly, they must have the capacity, professional qualifications, and expertise to undertake the professional titles one rank higher than their current rank in the same professional field.
Thirdly, they must meet the requirements of diplomas, certificates, and other criteria of the professional title they are applying for. In cases where public employees are exempt from foreign language and information technology exams according to Clauses 6 and 7 of Article 39 of this Decree, they must meet the foreign language and IT standards of the professional title they are applying for.
Fourthly, they must meet the minimum working period requirement of holding the professional title one rank below the desired professional title according to the standards for the title they are applying for.
For public employees who, before being recruited or received, have a working period contributing to compulsory social insurance according to the regulations of the Law on Social Insurance, and worked in positions requiring matching professional qualifications (if the working period was not continuous but they have not received a lump-sum social insurance payout, the periods are accumulated), and this time is considered by the competent recruiting agency/unit to rank the current professional title, it will be considered equivalent to the rank of the currently held professional title.
If there is equivalent time, there must be at least 01 year (12 months) holding the professional title one rank below the desired professional title up to the time the registration dossier submission deadline is reached.
Ministries managing professional titles for specialized public employees shall specify the standards and conditions for taking the exam or consideration for the rank promotion to professional titles of public employees in the sectors and fields assigned for management, after reaching an agreement with the Ministry of Home Affairs.
