This is one of the standards required for officials in the position of execution secretary as stipulated in Circular 03/2017/TT-BTP issued by the Ministry of Justice on April 05, 2017.
Circular 03 stipulates that an enforcement secretary is a professional specialist in civil judgment enforcement, responsible for assisting senior enforcement officers and intermediate enforcement officers in implementing the procedures and processes involved in civil judgment enforcement and administrative judgment enforcement, or assisting senior reviewers and main reviewers in performing tasks related to verifying ongoing and completed enforcement cases, as well as investigating and verifying cases involving complaints or denunciations related to civil judgment enforcement in accordance with the law.
Simultaneously, Circular 03 also prescribes that an enforcement secretary must meet the following standards regarding professional capacity and expertise:
- Firmly grasp the principles, guidelines, and policies of the Communist Party, as well as the state laws related to civil judgment enforcement;- Have a solid understanding of the basic legal knowledge and proficiency in civil judgment enforcement;- Possess the capability to aggregate and propose solutions to issues related to the duties of an enforcement secretary;- Demonstrate drafting skills for documents related to the assigned roles and responsibilities;- Civil servants taking the promotion examination for the position of Enforcement Secretary must have held the intermediate rank of Enforcement Secretary for at least 3 years (36 months).
