The following article pertains to the periodic rotation of work positions in the field of education and training at local authorities in Vietnam, as stipulated in Circular 19/2024/TT-BGDDT.

On November 28, 2024, the Minister of Education and Training of Vietnam issued Circular 19/2024/TT-BGDDT stipulating the list and term for periodic rotation of work positions under the management scope of the education and training sector at local authorities.
According to the provisions of Article 3 of Circular 19/2024/TT-BGDDT, the term for periodic rotation of work positions under the management scope of the education and training sector at local authorities is as follows:
- The term for periodic rotation of work positions in the field of education and training specified in Article 2 of Circular 19/2024/TT-BGDDT ranges from 3 (three) to 5 (five) years, specifically:
+ Enrollment and training at public schools.
+ Allocation of targets, management of enrollment for educational institutions within the national education system; allocation of postgraduate training targets and overseas training targets at agencies and units under the management authority of local authorities.
+ Appraisal and approval of training and fostering programs of educational institutions within the national education system.
+ Appraisal of local educational materials, teaching materials, educational tools, and other technical supplies for teaching and research.
+ Appraisal of dossiers for the establishment and permission to operate education of educational institutions within the national education system under management scope.
+ Management of schemes and projects in the field of education and training.
+ Allocation and appraisal of scientific research topics in the field of education and training.
- The timing for calculating the period for transferring work positions is the time when there is a document on mobilization, arrangement, and task assignment by authorized levels in accordance with the law.
According to the current regulation, the period for regular transfer of work positions under the management scope of the education and training sector at local authorities is specifically stipulated in Article 3 of Circular 41/2021/TT-BGDDT as follows:
“Article 3. Period for Regular Transfer of Work Positions
1. The period for regular transfer of work positions ranges from 3 (three) to 5 (five) years (excluding the probation period for officials and public employees). The timing for calculating the transfer period is the time when there is a document on mobilization, arrangement, and task assignment by authorized levels in accordance with the law.
2. Units issue a list of work positions that require regular transfers based on the provisions in Clause 1 of this Article to determine the regular transfer period for each specific work position.”
Note:
- For subjects subject to regular transfer of work positions as specified in Clause 2, Article 1 of Circular 19/2024/TT-BGDDT that have been transferred in accordance with Circular 41/2021/TT-BGDDT before this Circular takes effect, agencies, organizations, and units are responsible for continuing to monitor and calculate the time of holding work positions to periodically review transfers according to the period prescribed in Circular 19/2024/TT-BGDDT.
- For departments, bureaus, offices, inspectorates, units established by the Minister of Education and Training, and public service providers under the Ministry of Education and Training (including higher education institutions), they must continue implementing according to the plans issued until there is a specific regulation from the Minister of Education and Training on the list and period for regular transfer of work positions for officials not holding leadership or management positions and public employees that have direct contact and work resolution within units under and affiliated with the Ministry of Education and Training.
