When there is a change of residence, especially for those who go to work or study far from home and need to rent a place or house, temporary residence registration is a mandatory requirement.
According to the provisions at Article 30 Law on Residence 2006:
*"1. Temporary residence registration is when citizens register their temporary residence location with the competent state authority and such authority completes the procedures for temporary residence registration and issues a temporary residence book for them.
Persons living, working, laboring, or studying at a location in a commune, ward, or commune-level town but are not eligible for permanent residence registration at that locality must register for temporary residence with the commune, ward, or commune-level town police within thirty days from the date of arrival...
In the event that a person has registered temporary residence but has not lived, worked, labored, or studied at the registered locality for six months or more, the agency that issued the temporary residence book must remove that person's name from the temporary residence registry."*
When registering for temporary residence, please note:
Within 30 days from the date of relocation, citizens must complete the temporary residence registration procedures.
The dossier includes:
- Personal declaration form- Notification form of household, personal changes- Documents proving legal residence (except for cases where the household head with a household registration book or temporary residence book agrees to allow temporary residence registration, there is no need to present legal residence documents). For cases of renting, borrowing, or staying at the legitimate residence, the consent for temporary residence registration from the renter, lender, or host is required on the notification form of household, personal changes, signed with full name and date.- Presentation of identity card or documents certified by the commune, ward, commune-level town police where the person has permanent residence- Submission place for the dossier: commune, ward, or commune-level town police where the temporary residence is located.
Processing time: Within 03 working days from the date of submitting a complete dossier, citizens will be registered for temporary residence and issued a temporary residence book.
Temporary residence registration fee: As regulated by the provincial or city People's Committee.
Temporary residence registration is a mandatory condition, therefore any violation will be penalized according to the provisions at Article 8 Decree No. 167/2013/ND-CP as follows:
*"1. A fine of VND 100,000 to VND 300,000 for the following acts:
a) Individuals, household heads failing to comply with permanent residence registration, temporary residence registration, or adjustments to changes in the household registration book, temporary residence book;b) Individuals, household heads failing to comply with lodging notification or temporary absence declaration;c) Failing to comply with residence inspection, temporary residence inspection, lodging inspection, or failing to present household registration book, temporary residence book, or other residence-related documents upon request by competent authorities.
Furthermore, Decree No. 167/2013/ND-CP also stipulates penalties for certain violations in registration and residence management as follows:
*“2. A fine of VND 1,000,000 to VND 2,000,000 for the following acts:a) Altering, erasing, modifying, or performing other acts to falsify the content of the household registration book, temporary residence book, or other residence-related documents;b) Providing false information or materials about residence;c) Renting or leasing the household registration book, temporary residence book, or other residence-related documents for illegal acts;d) Using the household registration book, temporary residence book, or other residence-related documents for illegal acts;e) Lodging businesses failing to notify the police when there are guests staying as required;f) Organizing, inciting, enticing, inducing, brokering, or coercing others to violate residence regulations.
In addition to monetary fines, there are also supplementary penalties such as confiscation of administrative violation means or materials and measures to remedy consequences.*
