The Law on Technology Transfer 2017 of Vietnam takes effect from July 01, 2018. According to this Law, technologies that are no longer popularly used and transferred in developing countries, technologies that use toxic chemicals, etc. shall be subject to banned transfer from foreign countries to Vietnam or domestically.
In order to prevent outdated technology from flooding into Vietnam, the Law on Technology Transfer 2017 of Vietnam clearly states that Vietnam’s Government is responsible for promulgating the List of technologies banned from transferring.Thus, the transfer of the following technologies from foreign countries to Vietnam or domestically shall be banned: Technologies that fail to satisfy regulations of laws on occupational safety and sanitation, protection of human health, resources and environment protection, and biodiversity; Technologies that are employed to create products adversely influencing on social – economic development or adversely influencing on the national defense and security or social order and security.
Besides, technologies that are no longer popularly used and transferred in developing countries and fail to satisfy national technical standards and regulations; technologies that use toxic chemicals or generate hazardous waste that fails to satisfy the national technical standards and regulations on environment; technologies that use or create radioactive substances that fail to satisfy the national technical standards and regulations shall also be subject to banned transfer from foreign countries to Vietnam or domestically.
The transfer of technologies on the List of state secrets from Vietnam to foreign countries is also banned, unless otherwise stipulated by law.
Transfer of generation or use of new or renewable energy; storage energy in highly efficient way, creation of products which concurrently serve national defense, security and civil purposes, etc. are encouraged from foreign countries to Vietnam or domestically by the Law on Technology Transfer 2017 of Vietnam.
