Decree 27/2012/ND-CP provides for the handling of disciplinary actions against public employees and the responsibility for compensation and reimbursement by public employees and takes effect from May 25, 2012.

Depending on the severity of the violation and the current position, the public employee who violates the law will be subjected to one of the following disciplinary actions: Reprimand; Warning; Dismissal or Compulsory Resignation.
Among these, the disciplinary form of compulsory resignation is applied to public employees committing one of the following legal violations:
- Sentenced to imprisonment without suspension or convicted by the court for corruption.
- Failing to comply with professional processes, regulations, professional ethics, and codes of conduct in professional activities causing particularly serious consequences.
- Using illegitimate documents to be recruited into the public service provider.
- Drug addiction confirmed by a competent medical authority.
- Arbitrarily taking leave, totaling 07 working days or more in a month or 20 working days or more in a year without justifiable reasons calculated based on the Gregorian calendar month or year.
- Committing particularly serious violations of the laws on anti-corruption, but not to the extent of criminal prosecution; laws on practicing thrift and combating wastefulness; labor discipline; prevention of social evils, and other regulations related to public employees.
