On 10/6/2024, the Ministry of Justice (Hanoi, Vietnam) issued Circular 05/2024/TT-BTP which stipulates the statistical reporting regime and methods for tracking of civil and administrative judgment enforcement.

Specifically, there will be 12 forms in the System of statistical forms of civil judgment enforcement in Vietnam from July 26, 2024, including:

  1. Civil execution results by case.
  2. Civil execution results by money amount.
  3. Execution results of state budget collections.
  4. Civil execution results by case divided by execution agency and executor.
  5. Civil execution results by money amount divided by execution agency and executor.
  6. Results of requests for exemption or reduction of civil execution obligations.
  7. Results of applying assurance and enforcement measures in civil execution.
  8. Results of handling complaints, denunciations, recommendations, and reflections on civil execution.
  9. Results of citizen reception in civil execution.
  10. Results of supervision, inspection, and examination of civil execution.
  11. Results of state compensation resolution in civil execution.
  12. Results of administrative execution tracking.

(Article 2 Circular 05/2024/TT-BTP)

Forms and methods of submission of statistical report on civil judgment enforcement in Vietnam from July 26, 2024

(1) Statistical report on civil judgment enforcement can be presented as either paper documents or electronic documents:

  • Paper reports must have the signature and name of the person who prepared the form, the signature and name of the head of the unit, and the official seal as required. Statistical reports by executors must have the executor’s signature and be verified by the unit head;
  • Electronic reports can be images (in pdf format) of the paper reports or electronic files authenticated with the digital signature of the head of the civil execution agency as per legal requirements.

(2) Statistical report on civil judgment enforcement are sent to recipients via the following methods:

  • Sent by official email provided by the Ministry of Justice (*@moj.gov.vn);
  • Sent via the Document Management Software of the Ministry of Justice (qlvb.moj.gov.vn);
  • Reports within the military follow the regulations of the Ministry of National Defense and the guidance of the Execution Department of the Ministry of National Defense (Hanoi, Vietnam).

Procedures and deadlines for submission of statistical report on civil judgment enforcement in Vietnam from July 26, 2024

Specifically, Article 10 of Circular 05/2024/TT-BTP regulates the procedures and deadlines for submission of statistical report on civil judgment enforcement in Vietnam from July 26, 2024 as follows:

  • Within 1 working day after the end of the reporting period, the executor must prepare and send the statistical report to the head of their unit.
  • Within 2 working days after the end of the reporting period, the District Civil Execution Sub-department must compile and prepare the statistical report and send it to the superior Civil Execution Department and other designated recipients.
  • Within 4 working days after the end of the reporting period, the Provincial Civil Execution Department must compile and prepare the provincial-wide statistical report and send it to the General Department of Civil Execution and other designated recipients.
  • Within 1 working day after the end of the reporting period, executors in military execution agencies must prepare and send the statistical report to the Chief of the Military Region Execution Department.
  • Within 2 working days after the end of the reporting period, the Military Region Execution Department must prepare and send the statistical report to the Military Region Commander, the Execution Department of the Ministry of National Defense, and other designated recipients.
  • Within 4 working days after the end of the reporting period, the Execution Department of the Ministry of National Defense (Hanoi, Vietnam) must compile and prepare the statistical report and send it to the Minister of National Defense, the Minister of Justice, and other designated recipients.
  • Within 6 working days after the end of the reporting period, the General Department of Civil Execution compiles national civil execution statistics, tracks national administrative execution, and military civil execution statistics, and reports to the Minister of Justice to report to the Prime Minister, National Assembly, and other competent authorities upon request.
