Suspension from study of cadres forging documents and diplomas to participate in training in Vietnam

I would like to know how the officers who are sent overseas for training and retraining will be handled if any violations occur. - Ly Minh (Hai Phong, Vietnam)

On October 5, 2022, the Steering Committee for the implementation of Conclusion 39: The Central Executive Committee issued Decision 02-QD/BCD on the Regulation on staff training according to Conclusion 39-KL/TW on the policy of fostering leading and managerial cadres abroad with the state budget. In particular, it stipulates the form of handling of violations by leading and managerial cadres who go abroad for training.

Specifically, Article 19 of the Regulation on staff training provides for handling violations of leading and managerial cadres as follows:

- Suspension of study for:

+ Officers who fail to meet the requirements and standards outlined in the Regulation on Staff Training;

+ Officers have committed acts of forgery in order to participate in the refresher course.

Using illegal diplomas and certificates

+ Absence from school for 3 consecutive days or more without a valid reason;

a) The cadre has been suspended from work, has violated the law, and has a legally binding court judgment;

+ Cadres no longer work in the political system.

- Reprimands and warnings for: cadres who violate the regulations but are not to the point of being suspended from study; depending on the specific level, will be disciplined in the form of reprimand or warning by the head of the standing agency, advising, proposing, and reporting to the Steering Committee's leadership for consideration and decision.

The process and procedures for handling violators in Vietnam

- Procedures and procedures for handling violations: Officers violate the Regulation to the extent that they have to be disciplined to make a self-criticism; all staff in the delegation/class gave comments and proposed disciplinary action. The Disciplinary Council shall meet and report to the Steering Committee's Leader for consideration and decision on the form of discipline.

- A dossier of requests for consideration of the handling of violations includes:

+ The staff's review;

+ Minutes of meeting to review and propose disciplinary forms of the delegation/class;

+ Relevant documents and evidence

- Disciplinary Council: Comply with the regulations of the Party and State.

Rights and responsibilities of officials sent abroad for training in Vietnam 

(1) 05 benefits for officers sent on training in Vietnam

Article 15 of the Regulation on Fostering Cadres stipulates that 05 rights of cadres sent for training are entitled, including:

- To receive benefits in accordance with the laws and regulations of the agency or unit that manages and employs cadres.

- To be allocated time and budget by the management and use agency according to regulations.

- The training time is counted into the continuous working time.

- To enjoy the regimes and allowances as prescribed by law.

- To be provided with full information about this regulation and the contents related to the training course.

(2) Duties of officials sent for training in Vietnam

According to Article 16 of the Regulation on staff training, the responsibilities of officials sent for training are prescribed as follows:

- General Responsibilities

+ Strictly abide by the Party's regulations, the laws of the State of Vietnam and the laws of the host country (in the case of training abroad).

+ Cadres must strictly comply with the Party and State's regulations on protection of state secrets, party secrets, and regulations on protection of internal politics.

+ Strictly maintain study and speech discipline.

+ Implement the Regulation on staff training and other current regulations on staff training under the management of the training institution and related management agencies during the time of participating in the training course.

+ Report the results of study and retraining in writing to the standing agency within 10 days after the completion of the training course.

For the delegation sent for training for 3 months or more, the team leader shall make a monthly report and a report after the completion of the training course.

For cadres who go abroad for training, the report on the results of training and retraining shall include the content of the implementation of regulations on protection of internal politics during the training period abroad.

+ In case of absence, the officer must submit an application for leave and send it to the standing agency at least one day before the leave.

- Responsibilities of officials sent abroad for training

* Team manager

The team leader is a member of the delegation appointed by the leader of the steering committee. The head of the delegation is the official representative and spokesman of the Vietnamese delegation and has the following responsibilities and powers:

+ Take charge and manage the delegation in order to strictly implement the training program and content of the delegation. Take overall responsibility for the study activities and foreign relations of the delegation; coordinate and assign tasks to the deputy head of the delegation, the secretary of the delegation, and the members of the delegation.

+ Maintain regular contact with the Standing Agency and related agencies and organizations on behalf of the delegation to discuss with host country training institutions and agencies matters related to delegation management, study, meals, lodging, travel, and activities during their stay abroad.

* Deputy Head of the delegation

The deputy head of the delegation is a member of the delegation appointed by the leader of the Steering Committee to perform tasks assigned by the team leader. The delegation leader authorizes a deputy leader to manage the delegation when he is absent or there is a reason for force majeure.

* Member of the team

+ Comply with the assignment of the leader of the delegation, fully participate in the study program and plan; implement regulations on internal organization of the delegation; actively participate in joint activities to build a unified delegation in terms of effective organization and professional activities; and strictly observe regulations on foreign affairs.

+ Responsible for reporting to the team leader on personal work that affects the group's activities; during studies and activities, must closely coordinate with the delegation members, the delegation's facilitators, and interpreters; show cultured behavior and respect for partners.

+ In the case of having to return home early for legitimate reasons, the members of the delegation must report to the head of the delegation. The personnel management agency shall make a written request to the Standing Body to report to the Steering Committee's leadership for consideration and decision.

* Secretary of the delegation

The secretary of the delegation is a member of the delegation appointed by the leader of the Steering Committee and has the following duties:

+ Prepare delegation reports on training and research results; synthesize delegation members' opinions to complete the report; submit to the team leader or team leader to sign the issuance.

+ For delegations without a support person, the secretary of the delegation is responsible for helping the leader of the delegation carry out regular transactions according to the working schedule, reception, and foreign affairs of the delegation; connecting information with related parties to ensure the internal activities and activities of the delegation; gathering invoices and vouchers; and completing the financial settlement documents for the delegation within 10 days after the completion of the training course.

- Responsibilities of officials who are sent for training in the country

* Responsibilities of the class staff

+ Monitor and urge the class to implement the learning program and foster content; take overall responsibility for the learning activities of the class; coordinate and assign tasks to class members.

+ Maintain regular contact with the training course's management board; report fully and honestly on the class's learning and training situation at the request of the refresher course's management board.

+ Build class of solidarity, discipline, emulation, study, and practice to well implement the plan, content, and program of the training course.

* Duties of class members

+ Comply with the assignment of the class staff, fully participate in the study program and plan; well implement the classroom rules and committed contents; actively exchange, discuss and participate in joint activities.

+ Responsible for reporting to the Class Personnel Committee on personal work that affects the training program; implementing cultural behavior in learning and living.
