This is noteworthy content in Circular 09/2017/TT-BNV amending and supplementing Circular 04/2012/TT-BNV guiding the organization and activities of villages and residential groups.
At present, the merger and dissolution of hamlets and residential groups are necessary to effectively carry out management of administrative territories. Therefore, detailed regulations on this issue are required for effective implementation. To be specific, Circular 09 stipulates the conditions for merging, dissolving, and classifying hamlets and residential groups as follows:
- The merger must ensure the following factors: it does not change the administrative boundaries of the commune-level administrative unit; the hamlets and residential groups to be merged are adjacent to each other, with uncomplicated terrain, facilitating economic - social development, production, business, and the stabilization of people's lives; more than 50% of voters or voter representatives of households in the relevant hamlets, residential groups agree...- In case of dissolution of a hamlet or residential group, the relocation, settlement arrangement, and resolution of related issues shall be carried out according to the Compensation and Resettlement Plan of the Project.- Regarding the classification of hamlets and residential groups: the Provincial People's Committee stipulates criteria for classifying hamlets and residential groups to enhance the effectiveness of population management and implement policies appropriate to the local reality.
