On December 28, 2018, the State Bank of Vietnam issued Circular 43/2018/TT-NHNN amending and supplementing Circular 16/2010/TT-NHNN guiding the implementation of Decree 10/2010/ND-CP on credit information activities.
Circular 43 has amended and supplemented the regulations on documents required to prove the conditions for issuing a Certificate of Eligibility for Credit Information Activities. Specifically, the documents under the new regulations include:
- The company's charter;- Contract with the network service provider;- List and explanation of information technology equipment and software used for the collection, processing, storage, and provision of credit information products;- Confirmation from a commercial bank regarding the balance of the deposit account in VND, gold, or foreign currency; confirmation from a professional appraisal organization for other contributed assets; or confirmation from an auditing organization on the minimum charter capital of 30 billion VND;- List of the titles in the company's management team;- Curriculum vitae of the management team;- Business plan;- Document from credit institutions, foreign bank branches committing to provide credit information to the company;- Agreement document on the process of collecting, processing, storing, and providing credit information between the company and the committed credit institutions.
