This is a new regulation added in Decree 08/2020/ND-CP on the organization and operation of Bailiff, issued on January 08, 2020.

To be specific, besides the appointment standards for enforcement officers previously stipulated in Decree 61/2009/ND-CP, Clause 5, Article 6 of Decree 08/2020/ND-CP introduces an additional new standard: “Meeting the requirements of the probationary results examination for the practice of enforcement officers.”
Therefore, according to this new regulation, starting from February 24, 2020, to be appointed as an enforcement officer, a Vietnamese citizen must meet the requirements of the probationary results examination for the practice of enforcement officers.
This is a new requirement added in this Decree. Previously, Decree 61/2009/ND-CP did not require passing such an examination but only required a certificate of completion of the training course for enforcement officers organized by the Ministry of Justice.
Furthermore, Decree 08/2020/ND-CP also limits the age for appointment as an enforcement officer to Vietnamese citizens not exceeding 65 years old, residing in Vietnam. (Decree 61/2009/ND-CP previously did not impose this age limit)
