Subjects Subject to Administrative Penalties in the Fisheries Sector

On May 16, 2019, the Government of Vietnam issued Decree 42/2019/ND-CP regulating administrative sanctions in the field of fisheries.

According to the provisions of Decree 42/2019/ND-CP, the following entities will be subject to administrative penalties for violations in the fisheries sector:

- Economic organizations established under the provisions of the Law on Enterprises, including: Private enterprises, joint-stock companies, limited liability companies, partnerships, and dependent units of enterprises (branches, representative offices);- Economic organizations established under the provisions of the Law on Cooperatives, including: Cooperatives, cooperative unions;- Organizations established under the provisions of the Law on Investment, including: Domestic investors, foreign investors, and economic organizations with foreign investment; representative offices, branches of foreign merchants in Vietnam; representative offices of foreign trade promotion organizations in Vietnam;- Social organizations, socio-political organizations, socio-professional organizations;- Public service units and other organizations as prescribed by law.

Note: Business households must register for business, households committing administrative violations will be penalized similarly to individuals.
