According to Article 6 of Circular 55/2022/TT-BCA, certificates of special duty are issued to officers and soldiers of the Mobile Police in case they are assigned to implement anti-terrorism combat plans and protect the transportation of special goods.
Article 5 of Circular 55/2022/TT-BCA regulates the content and appearance of the Certificate of special duty of Mobile Police as follows:
- Shape and size: rectangular, length: 85.6 mm ±0.1 mm, width: 54.0 mm ±0.1 mm.
- Contents of the Certificate of special duty:
+ Front: bright red background, surrounded by a gold border measuring 49 mm x 81 mm.
From top to bottom in order:
++ The words “CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM”; “SOCIALIST REPUBLIC OF VIET NAM”;
++ Full-color mobile police symbol, diameter 23 mm;
++ The words “GIẤY CHỨNG NHẬN CÔNG TÁC ĐẶC BIỆT” and “CERTIFICATION OF SPECIAL DUTY”;
Yellow letters.
+ Back side: light blue background, surrounded by a blue border, in the middle of the frame is imprinted with a 21 mm diameter Police badge, surrounded by a fan-shaped pattern.
The bottom left has a security stamp;
Below the stamp are the words “Number:…..”, in black;
On the right there are four lines of text, in black in order from top to bottom: "Hanoi, day... month... year..."; “Hanoi, Date… month… year…”; "BỘ TRƯỞNG BỘ CÔNG AN"; “MINISTER OF PUBLIC SECURITY”.
Signed by the Minister of Public Security, stamped by the Ministry of Public Security, and full name of the Minister.
The authority to issue, change, re-issue, deliver, revoke, and destroy certificates of special duty is specified in Article 7 of Circular 55/2022/TT-BCA as follows:
- The Minister of Public Security decides to issue, change, reissue and destroy certificates of special duty.
- Commander of the Mobile Police, Provincial Police and centrally run cities decide to assign certificates of special duty to units under their authority.
- Heads of Mobile Police units under the Mobile Police Command and Provincial Police are responsible for assigning certificates of special duty to officers and soldiers under management and recovery after completing the task.
The assignment and revocation of certificates of special duty must be expressed in writing.
Article 11 of Circular 55/2022/TT-BCA stipulates the responsibility for managing certificates of special duty as follows:
- The Mobile Police Command is responsible for making a book to monitor the issuance, exchange, re-issuance, delivery and revocation of certificates of special duty.
- Every month, the unit directly managing the subject assigned the Certificate of special duty must check the management and use and report the results to the Mobile Police Command.
- Annually, the Provincial Police reports on the management and use of certificates of special duty within the scope of management to the Mobile Police Command to synthesize and report to the Minister of Public Security on the management and use of certificates of special duty.
When officers and soldiers of the Mobile Police present their certificates of special duty and People's Police ID card
According to the provisions of Article 13 of Circular 55/2022/TT-BCA, agencies, organizations and individuals are responsible for strictly implementing the decisions and requests of that person according to the provisions of Clauses 1 and 2, Article 32 of the Mobile Police Law 2022 (effective from January 1, 2023) as follows:
- Timely provide competent persons with information and documents related to the work of the Mobile Police.
- Comply with decisions and requests of the Mobile Police according to the provisions of Clause 6, Article 10 and Article 16 of the Law on Mobile Police 2022.
Accordingly, agencies, organizations and individuals are responsible for complying with the following decisions and requirements:
+ Request agencies, organizations and individuals to provide diagrams and designs of works, headquarters, houses, vehicles,
except for defense works, military zones, and vehicles under the management of the Ministry of National Defense;
+ Access to headquarters of agencies, organizations, and individuals' residences to fight terrorism and rescue hostages.
+ In urgent cases to protect national security, ensure social order and safety or to prevent damage to society that is occurring or is at risk of occurring, mobile police officers and soldiers are allowed to mobilize civilian people, vehicles, and equipment and the people using and controlling those vehicles and equipment.
Mobile Police officers and soldiers request foreign organizations and individuals for support and assistance to carry out their tasks
according to the provisions of Vietnamese law and international treaties to which the Socialist Republic of Vietnam is a member.
Circular 55/2022/TT-BCA takes effect from January 1, 2023, replacing Circular 31/2014/TT-BCA.
