The 2013 Bidding Law allows for preferential treatment of certain contractors in order to prioritize and encourage domestic investors and to support disadvantaged contractors, such as small enterprises, those employing a significant number of women, and persons with disabilities...
To be specific, the entities eligible for bidding preferences include:
- Domestic and international bidding for the supply of goods: Preferences are given to contractors with domestic production costs comprising 25% or more of those goods.- International bidding for the provision of consulting services, non-consulting services, and construction: Preferences apply to the following:- Domestic contractors participating independently or in a consortium;- Foreign contractors forming a consortium with domestic contractors where the domestic contractors undertake 25% or more of the contract value.- Domestic bidding for the provision of consulting services, non-consulting services, and construction: Preferences apply to the following entities:- Contractors with 25% or more female employees;- Contractors with 25% or more employees who are war invalids or persons with disabilities;- Contractors that are micro-enterprises or small enterprises.
Preferences can be calculated in one of the following two ways:
- Adding points to the evaluation score of contractors eligible for preferences;- Adding an amount to the bid price or the evaluated price of contractors not eligible for preferences.
