Regarding this issue, LawNet would like to answer as follows:

On February 5, 2024, the National Assembly Standing Committee issued Resolution 43/2024/UBTVQH15 regulating the commemorative medal "For the cause of the National Assembly of Vietnam".

1. Subjects considered for awarding the commemorative medal "For the cause of the National Assembly of Vietnam"

According to Article 4 of Resolution 43/2024/UBTVQH15, subjects considered for awarding the commemorative medal "For the cause of the National Assembly of Vietnam" include:

(1) Leaders and former leaders of the Party and State; leader of the Central Committee of the Vietnam Fatherland Front.

(2) Leaders of ministries, departments, branches, and socio-political organizations at the central level; leaders of provinces and centrally run cities.

(3) Chairman of the National Assembly, Vice Chairman of the National Assembly, Member of the National Assembly Standing Committee, General Secretary of the National Assembly - Chairman of the National Assembly Office, Chairman of the Ethnic Council, Chairman of the National Assembly Committees and Head of the National Assembly Standing Committee. Former Chairman of the National Assembly, former Vice Chairman of the National Assembly, former Member of the National Assembly Standing Committee, former General Secretary of the National Assembly, former Chairman of the National Assembly Office, former Chairman of the Nationalities Council, Former Chairman of the National Assembly Committee and former Head of the Committee of the National Assembly Standing Committee.

(4) National Assembly Delegate.

(5) Leaders of the National Assembly Office, leaders of agencies under the National Assembly Standing Committee, and officials and civil servants under the management authority of the National Assembly Standing Committee.

(6) Civil servants, public employees, and workers of the National Assembly Office, the Institute of Legislative Studies, the Office of the National Assembly Delegation, and the People's Councils of provinces and centrally run cities.

(7) Vietnamese citizens are not subject to the above regulations.

(8) People of Vietnamese origin residing abroad, foreigners.

2. Criteria for awarding the commemorative medal "For the cause of the National Assembly of Vietnam"

Criteria for awarding the commemorative medal "For the cause of the National Assembly of Vietnam" are specified in Article 6 of Resolution 43/2024/UBTVQH15 as follows:

- Individuals specified in clauses (1), (2) and (3) of section 1 comply well with the Party's guidelines, policies and laws of the State and contribute to the development process of Vietnam National Assembly.

- Individuals specified in Clause (4) and Clause (5) of Section 1 comply well with the Party's guidelines and policies and the State's laws and meet one of the following standards:

+ Have time to participate as a National Assembly deputy for one full term or more;

+ Leaders of the National Assembly Office, leaders of agencies under the National Assembly Standing Committee, officials, and civil servants under the management authority of the National Assembly Standing Committee who have held positions for 5 years or more, regardless of the time of disciplinary action.

- Individuals specified in clause (6) of Section 1 comply well with the Party's guidelines and policies, the State's policies and laws, and meet the following standards:

+ Was awarded a commemorative commemorative medal from the Office of the National Assembly;

+ Have at least 05 years of successfully completing tasks or more from the date of being awarded the Commemorative commemorative medal by the Office of the National Assembly.

- Individuals specified in Clause (7) Section 1 comply well with the Party's guidelines, policies, and laws of the State and meet one of the following standards:

+ Make a worthy contribution to the development process of the Vietnam National Assembly;

+ Have initiatives, scientific topics, scientific projects, and scientific and technological works that has been recognized or accepted by a competent state agency and has practical value, making a practical and effective contribution to the development process of the National Assembly of Vietnam.

- Individuals specified in clause (8) Section 1 comply well with Vietnamese policies and laws and meet one of the following standards:

+ Contribute to the development process of the Vietnam National Assembly;

+ Contribute to building and strengthening cooperative relations between countries, international organizations, and the National Assembly of Vietnam.

3. Subjects who have not or are not considered for awarding the commemorative medal "For the cause of the National Assembly of Vietnam"

Pursuant to Article 5 of Resolution 43/2024/UBTVQH15, the subjects who have not or are not considered for commemorative medals are specified as follows:

- Subjects not yet considered for awards include:

+ Individuals while the competent authority is considering disciplinary action, investigation, inspection, or examination when there are signs of law violations, complaints, denunciations, corruption, or negative issues that are being verified and clarified;

+ Individuals are being prosecuted for criminal liability or are being disciplined.

- Subjects not considered for awarding commemorative medals include:

+ National Assembly deputies are dismissed; Civil servants and public employees are forced to quit their jobs; Employees specified in clause (6) of Section 1 will be disciplined and dismissed;

+ The individual has been convicted of a crime by a legally effective judgment or decision of the Court.
