According to Decree 120/2020/NĐ-CP, the structure of the management council of public service providers in Vietnam is regulated as follows:

- The management council consists of 5 to 11 members.

- The chairman and other members of the management council are appointed by the head of the authorized agency based on the approved self-governance plan of the public service providers.

- The term of the management council members is not more than 5 years. The structure and number of management council members in public service providers within sectors and fields are determined according to the regulations of specialized laws and the guidance of the sector or field management authority.

- Representatives of the higher-level management agency of the public service providers in the management council include representatives from ministries, equivalent agencies, government agencies, organizations established by the government or the Prime Minister, provincial People's Committees, and direct higher-level management agencies (if any), who work on a concurrent basis.

At the same time, the operating regulations of the management council are specified as follows:

- The management council operates according to the approved operating regulations issued by the competent authority, in accordance with the guidance of the sector or field management authority.

- The relationship between the management council and the heads of the public service providers is defined in the operating regulations of the management council, including: the management council makes decisions on matters within its authority based on the proposals of the heads of the public service providers; the heads of the public service providers manage and implement the resolutions of the management council; and takes responsibility before the management council for the results of the implementation.

- The relationship between the management council and the higher-level management agency is defined in the operating regulations of the management council, including: the management council is accountable to the higher-level management agency for the results of the assigned tasks and authorities; the management council is responsible for reporting to the higher-level management agency on the activities of the public service providers; and the higher-level management agency approves or provides opinions on matters within its authority based on the proposals of the management council.
