On November 29, 2023, the Minister of Agriculture and Rural Development issued Circular 12/2023/TT-BNNPTNT on guidance on the Management Council and standards and conditions for appointment and dismissal of Management Council members of public service units in the field of agriculture and rural development.

1. Structure of members of the Management Council of pubic service unit in the field of Agriculture and Rural Development in Vietnam

(1) The Management Council has from 05 to 11 members, depending on the characteristics of the unit, including the Chairman, Secretary, and other members. Depending on task requirements, the Management Council may have a Vice Chairman of the Council. The Chairman and other members of the Management Council are appointed by the head of the agency competent to approve the autonomy project of the public service unit. The term of office of a member of the Management Board shall not exceed 05 years.

(2) Composition of the Management Board

- The Chairman of the Management Council is the leadership representative of the public service unit or representative of the immediate superior management agency of the public service unit; the Chairman of the Management Board is not also the head of a public service unit;

- Representative of the superior management agency and the immediate superior of the public service unit (in case the Chairman of the Council is the leadership representative of the public service unit) or representative of the leader of a public service unit (in case the Chairman of the Council is a representative of the superior management agency or the immediate superior);

- Representatives of leaders of a number of departments and divisions of public service units (if any). In the event that there is no affiliated organization, a representative of an employee of a public service unit shall be appointed to participate in the Management Council;

- Representatives of Party committees and unions of public service units;

- Representative of relevant organizations and units (if any).

(3) The number, structure, and specific composition of members of the Management Council are decided by the head of the agency competent to approve the autonomy project of the public service unit according to the provisions of (1) ).

2. Duties and powers of members of the Management Council in the Agriculture and Rural Development Unit

(1) Chairman of the Management Board

- Operate, direct, and organize the implementation of tasks and powers of the Management Council according to the provisions of Article 4 of Circular 12/2023/TT-BNNPTNT;

- Organize the monitoring and evaluation of the implementation of strategic goals and operational results of public service units; management results of heads of public service units;

- Direct the development of term-based, annual, and quarterly operating plans of the Management Board; lead the implementation of resolutions of the Management Council;

- Convene and chair meetings of the Management Board; direct the preparation of meeting programs and documents; or collect opinions from members of the Management Council;

- Sign documents within the authority of the Management Council according to regulations;

- Assign tasks and supervise the performance of tasks by members of the Management Council;

- Carry out the duties of members of the Management Council specified in (4) and other duties and powers according to the provisions of law and operating regulations of the Management Council.

(2) Vice Chairman of the Management Board (if any)

- Manage operations and sign documents of the Management Board as authorized by the Chairman of the Management Board;

- Carry out the duties and powers of members of the Management Council specified in (4) and other duties and powers according to the operating regulations of the Management Council.

(3) Secretary of the Management Council

- Synthesize information about the unit's operations to report to the Chairman of the Management Board; Prepare the agenda, content, and documents; send meeting invitations; and act as secretary of meetings for the Management Board; Build, complete, and archive documents for the Management Council;

- Prepare reports and written explanations for state management agencies and relevant agencies according to the functions and tasks of the Management Council;

- Carry out the duties and powers of members of the Management Council specified in (4) and other duties and powers according to the operating regulations of the Management Council.

(4) Member of the Management Board

- Carry out tasks assigned by the Chairman of the Management Council; other tasks and powers according to the provisions of law and operating regulations of the Management Council and public service units;

- Participate in developing term and annual activity plans; Propose content and issues to be discussed at the Management Board meeting;

- Attend meetings of the Management Board, give opinions, and vote on issues discussed in meetings of the Management Board;

- Be provided with and access information and documents to serve the work of the Management Council according to regulations.
