Strictly Prohibiting the Evasion of Responsibilities by Reserve Military Personnel

This is a new provision stipulated in the 2019 Law on Reserve Forces passed by the National Assembly on November 26, 2019, at the 8th session of the 14th legislature.

HV Strict Prohibition in Mobilizing Reserve Forces, Reserve Force Law 2019

To be specific: Reserve Force Law 2019 strictly prohibits reserve forces, reserve military personnel from performing the following acts in the construction and mobilization of the reserve force:

- Evading the responsibilities of reserve military personnel, obligations of the owners of technical reserve vehicles that are mobilized or deployed.- Resisting or obstructing the construction and mobilization of the reserve force.- Mobilizing or deploying the reserve force not included in the approved plan.- Abusing or misusing the performance of duties in the construction and mobilization of the reserve force to infringe upon national interests, and the legitimate rights and interests of agencies, organizations, individuals.- Gender discrimination in the construction and mobilization of the reserve force.

In which:

- The reserve force includes reserve military personnel and technical reserve vehicles that are registered, managed, and organized into reserve units ready to supplement the standing force of the People's Army.

- Reserve military personnel include reserve officers, reserve professional soldiers, and reserve non-commissioned officers and soldiers registered according to the provisions of the Law on Officers of the Vietnam People’s Army, Law on Professional Soldiers, Defense Workers and public employees, and the Law on Military Service.

Moreover, Reserve Force Law 2019 also stipulates the responsibilities of reserve military personnel arranged in reserve units:

- Undergo health checks;- Comply with orders for training, drills, readiness checks for mobilization and combat readiness;- Adhere to policies of reserve unit activities and duties assigned by the commander;- Comply with mobilization orders to supplement the standing force of the People's Army.

Furthermore, reserve military personnel holding command positions in reserve units have the following responsibilities:

- Fulfill the responsibilities as for other reserve military personnel arranged in reserve units;- Monitor the quantity and quality of the unit; maintain unit activities according to policies and fulfill reporting policies;- Manage and command the unit during training, drills, readiness checks, and combat readiness;- Manage and command the unit to supplement the standing force of the People's Army.
