Storage of Exhibits in Civil Judgment Enforcement

Circular 01/2017/TT-BTP was issued by the Ministry of Justice on January 23, 2017, specifying regulations regarding the storage of exhibits in the enforcement of civil judgments.

Circular 01 stipulates the provisions on evidence storage as follows:

Evidence storage must meet the scale and standard requirements as prescribed by the Minister of Justice; it must have adequate necessary equipment to preserve the assets in custody and evidence; and must ensure security, safety, environmental hygiene, and other requirements in the preservation of evidence and assets in custody.

In cases where there is no evidence storage or the quantity of evidence and assets in custody is too large for the available storage to accommodate, the civil judgment enforcement agency may rent storage for preservation purposes.

Rented storage must meet requirements regarding equipment, security, and safety, and the preservation and handling of evidence and assets in custody in the rented storage shall be conducted similarly as in the evidence storage of the civil judgment enforcement agency.

Additionally, Circular 01 stipulates, based on the practical conditions of each unit, that the Head of the civil judgment enforcement agency shall arrange a room or working area for the evidence custodian and the storage security personnel. In case the evidence storage is located within the headquarters of the civil judgment enforcement agency, the agency's security personnel are responsible for protecting the evidence storage.
