Recently, the Ministry of Agriculture and Rural Development issued Circular 29/2019/TT-BNNPTNT stipulating the handling of wild animals as evidence, exhibits, and wild animals voluntarily surrendered to the State by organizations or individuals.

According to the regulations, the wildlife, which are physical evidence allowed for commercial purposes and cannot be processed according to the forms prescribed in Article 11, Article 12, and Article 13 of Circular 29/2019/TT-BNNPTNT, will be sold to organizations and individuals according to the law. The sale of wildlife must be confirmed by the specialized veterinary management agency or by the State-managed wildlife rescue facility regarding the wildlife not falling into the case of being destroyed as per the health status verification record of wildlife according to Form No. 02 issued with this Circular.
The head of the authority competent to handle wildlife issues decides to sell wildlife in accordance with the law on management and use of public property.
Additionally, Circular 29/2019/TT-BNNPTNT also stipulates that wildlife with epidemics or wildlife that cannot be processed by the forms prescribed in Article 11, Article 12, Article 13, and Article 14 of this Circular or must be destroyed according to the law will be destroyed as prescribed.
Form of destruction: Depending on the nature and characteristics of the wildlife being destroyed, the competent authority decides one of the following forms of wildlife destruction: mechanical, incineration, burial, chemical use, or other forms prescribed by law to ensure the wildlife no longer exists, has no value, and does not affect the environment.
Procedure implementation:
- The head of the authority competent to handle wildlife issues issues a decision to destroy the wildlife;
- Participants in destruction: The agency or unit in charge of destroying wildlife, the local Forest Protection Department, the leading agency or unit may invite witnesses, competent authorities to proceed if the wildlife is physical evidence, local authorities, media agencies, and related parties;
- The agency or unit presiding over the destruction of wildlife makes a record of wildlife destruction according to Form No. 05 issued with this Circular.
