The standard for signing employment contract in the People's Police of Vietnam is specified in Circular 22/2022/TT-BCA issued on May 10, 2022 .

The Minister of Public Security of Vietnam issued Circular 22/2022/TT-BCA dated May 10, 2022 providing for employment contracts in the People's Police.

1. Subjects eligiblae to sign employment contracts in the People's Police of Vietnam

According to Article 5 of Circular 22/2022/TT-BCA which stipulates the subjects who sign employment contracts in the People's Police as follows:

- Subjects who sign employment contracts in the People's Police are specified in the Appendix issued with Circular 22/2022/TT-BCA.

For jobs not specified in the Appendix that the police units or localities wish to use, the director of the Department of Organization and Personnel shall be requested to appraise them and submit them to the Minister of Public Security for approval.

- The director of the Department of Organization and Personnel shall be in charge of formulating norms for the use of contract workers with state budget salaries for each specific job and reporting to the Minister for decision.

2. Subjects ineligibe to sign employment contracts in the People's Police of Vietnam

Subjects who do not sign employment contracts in the People's Police according to Article 6 of Circular 22/2022/TT-BCA are as follows:

- Professional officers and non-commissioned officers; professional and technical officers and non-commissioned officers; non-commissioned officers and servicemen in the People's Public Security.

- Chairman of the Members' Council, President of the Company (for companies without a Members' Council), Members of the Members' Council, General Director (Director), Deputy General Director (Deputy Director), Controller, Chief Accountant, State Capital Portion Representative in the Enterprise;

Directors, deputy directors, and chief accountants of companies, branches, and member enterprises; directors, deputy directors, and chief accountants of guest houses, resorts, and public service houses, self-financed public non-business units.

- Cleaning, housekeeping, and maintenance are performed by public security workers in the Ministry of Public Security's serving halls, meeting rooms, and working rooms.

3. Standards for signing employment contracts in the People's Police of Vietnam

Standards for signing employment contracts in the People's Police according to Article 7 of Circular 22/2022/TT-BCA are as follows:

* General Standard:

Being a citizen of the Socialist Republic of Vietnam, having a permanent address in Vietnam; having good moral character, strictly abiding by the lines and guidelines of the Party, policies and laws of the State; having a clear background, and being certified by the commune-level police station where he/she resides.

* Age:

- For employees receiving state-funded salaries:

From 18 years old and up. Priority is given to entering into contracts with employees who are eligible for the period of social insurance premium payment in order to enjoy a pension when the employees reach the retirement age in accordance with the provisions of the Labor Code;

- For employees at enterprises and public non-business units with financial autonomy: comply with the provisions of the Labor Code and current guiding documents and regulations.

* Qualification:

Having the necessary qualifications as required by the employer. Do not recruit workers without vocational training or national certificates of vocational skills for jobs requiring workers who have been trained in vocational training or who must have national certificates of vocational skills.

* Health:

Having enough health to work according to the conclusion of the medical examination and treatment establishments at the district level or higher level.

* Political standards:

- For employees who sign a employment contract with an indefinite term or a employment contract with a definite term of 12 months or more and receive a salary from the State budget:

Themself; father, mother; father, mother-in-law or husband; the person who has directly brought up his or her own, spouse's, from childhood; wife or husband; their own brothers, sisters and brothers must meet the political standards as prescribed in Article 5 of Circular 22/2022/TT-BCA;

- Employees who sign employment contracts with a fixed term of less than 12 months and are paid from the state budget, as well as employees at enterprises and public non-profit organizations with financial autonomy, do not fall into one of the following categories:

Being applied administrative handling measures in one of the following forms: Education in communes, wards, and townships; compulsory education establishments; sent to a compulsory detoxification establishment, but not more than 02 years from the date of completing the execution of the sanctioning decision;

Being the subject of a lawful investigation, prosecution, and trial by competent authorities;

Being found guilty by a court and receiving a legally effective sentence for a serious crime or more serious crime, but whose criminal record has not been expunged; Drug addict;

- A contract worker with indefinite term and with a definite term of 12 months or more receiving a state budget salary who gets married must meet the political standards specified at Point a of this Clause;

- Contract workers with state budget salaries working in key and secret units and sections of the People's Police must ensure the political standards of officers and soldiers of the People's Public Security.

Circular 22/2022/TT-BCA takes effect from July 1, 2022, replacing Circular 68/2019/TT-BCA.
