The Minister of Public Security promulgates Circular 09/2021/TT-BCA dated January 20, 2021 providing for inspection of command, military, and martial arts units of the People's Public Security.

Thus, the standards of the officers performing the inspection and investigation of the People's Police orders are prescribed as follows:

1. Criteria for officers performing the inspection and investigation of the People's Police's orders in Vietnam

In Article 3 of Circular 09/2021/TT-BCA stipulating the standards, the number of officers in charge of inspecting orders of the People's Police is as follows:

1.1. General standards of officers performing the inspection and investigation of the People's Public Security's orders

Having good political and moral qualities, strictly obeying the orders of the People's Public Security; having qualifications, professional capacity, and legal capacity; and mastering and strictly complying with regulations on command, military, and martial arts work and other regulations related to command, military, and martial arts work.

1.2. Specific standards for officers in charge of inspecting and investigating People's Police orders

A full-time officer in charge of inspecting and administering orders of the People's Police must ensure the following conditions: Being a professional officer, having a police intermediate degree or higher, having actually worked in the police for 5 years or more; having received command training, military training, and martial arts training in accordance with regulations on command training, military training, and martial arts training in the People's Police; being granted a Certificate of Inspection and Order;

Part-time officers who inspect and investigate People's Public Security orders must satisfy the following conditions: having a police intermediate degree or higher. If they graduate from a university in a foreign discipline, they must receive professional training in public security; have worked in the Police for at least 3 years; be capable of command work, military training, and martial arts to meet the requirements of command work;

Note:

Do not assign a full-time officer to inspect and administer the People's Public Security's orders to the following comrades: Professional and technical officers and non-commissioned officers; who have been disciplined by the party, administration, or mass organizations for the period of 05 years immediately preceding the time of assignment; have results of classification of officers who have achieved the level of task completion for 2 consecutive years and have not completed their tasks in the last 1 year.

2. Number of officers in charge of inspecting and investigating People's Police orders in Vietnam

- Provincial and centrally-run city police, academies, and people's public security schools (except the School of Culture) shall arrange for 3 to 5 full-time officers and a number of part-time officers.

For the Hanoi City Police and the Ho Chi Minh City Public Security Department to arrange for five or more full-time officers; the exact number is determined by the unit's commander.

- The units under the Ministry of Public Security shall arrange for from 01 to 03 full-time officers and a number of part-time officers.

For the Guard Command, the Mobile Police Command, and the Police Department managing prisons, compulsory education institutions, and reformatory schools, the Immigration Department shall arrange for 03 to 05 full-time officers and a number of part-time officers; the specific quantity is decided by the head of the unit;

- Police of districts, towns, cities, stations, and the equivalent under provincial-level Public Security; regiments, crews, battalions, fleets, and independent companies of the regiment shall form a semi-specialized command team consisting of a number of part-time officers, the number of which is determined by the unit's commander;

- Unit-level units, communes, wards, townships, and stations, based on the actual situation, the head of the unit shall assign part-time officers to inspect the People's Police orders.

3. Duties of the People's Police command inspection officer in Vietnam

The duties of the People's Police command inspection officer are outlined in Article 4 of Circular 09/2021/TT-BCA:

- Carry out inspection of People's Police orders according to the provisions of Circular 09/2021/TT-BCA.

- Implement the Ministry of Public Security's, the Department of Party and Political Work's, and the heads of public security in the units and localities' directions on the inspection and regulation of the people's public security.

- Advise and guide police units, localities, and People's Public Security officers and soldiers to strictly adhere to command, military, and martial arts regulations.

- Propose praising and commending units and individuals for adhering to command, military, and martial arts regulations.

- Remind, correct, or request that units, officers, and soldiers who violate the People's Public Security Regulations be dealt with promptly.

- Request that competent authorities take steps to address issues and deficiencies in documents governing the work of the People's Public Security Forces. 

4. Powers of the People's Public Security Command Inspection Officer in Vietnam

Pursuant to Article 5 of Circular 09/2021/TT-BCA, the powers of officers who inspect and investigate the People's Police orders are as follows:

- Reminding, correcting, and making minutes of violations of the People's Public Security's orders

+ Leaders and officers of the Command, Military and Martial Arts Department of the Department of Party and Political Work are reminded, corrected, made minutes and requested to handle units, cadres, and soldiers that violate the regulations of the People's Public Security in the entire police force;

+ Leaders and officers inspecting and executing police orders of units and localities are entitled to:

Reminding, correcting, making minutes, and proposing the handling of units, officers, and soldiers violating regulations of the People's Police under their units and localities.

Reminding, correcting, and making minutes for officers, soldiers, and students of other units, localities, academies, and People's Public Security Schools to work, study, and live at the units and localities. if there is a violation of the People's Public Security order; for officers, soldiers, and students of agencies, units, academies, and schools of People's Public Security stationed in their respective localities when those cadres, soldiers, and trainees violate the regulations of the People's Public Security outside their agencies or barracks.

After checking and making a record, a written notice must be sent to the unit or locality managing the violating cadres for handling according to regulations; at the same time, send notices to the Bureau of Party and Political Work for general monitoring.

- Temporarily seizing documents, means, and objects related to a violation of People's Police regulations in order to facilitate the investigation. The request for a temporary seizure must be made in writing according to Form No. 06 attached to this Circular.

- Using means and techniques such as: cars, motorcycles, video recorders (cameras), cameras, recorders, alcohol meters when performing tasks.

- Disguising (not wearing the People's Police uniform) when performing the task of secret inspection and secret inspection combined with publicity.

- Requesting cadres and soldiers who violate the People's Public Security Command to go to the nearest police station or unit for settlement.
