On July 24, 2024, the Minister of Construction issued Circular 03/2024/TT-BXD guiding the Management Council and standards, conditions for appointment, removal of members of the Management Council in public service providers in the construction sector in Vietnam.

According to Article 8 of Circular 03/2024/TT-BXD, the standards and conditions for members, Chairman of the Management Council in public service providers in the construction sector in Vietnam are as follows:

(1) Standards for members of the Management Council.

- Possess good political qualities, ethics, lifestyle, and disciplinary consciousness.

- Have sufficient health to complete assigned tasks and responsibilities.

- Have a university degree or higher.

- Not undergoing disciplinary action or under consideration for disciplinary action as prescribed by law.

- Age ensures at least one term (5 years) of service.

- Not being the spouse, parent, child, or sibling of the head, deputy head, chief accountant of the public service provider.

(2) Standards for the Chairman of the Management Council

- Meet standards for members of the Management Council.

- Have management experience or expertise in the field of operation of the public service provider. Have management capability and meet the conditions, standards as stipulated by law and the competent authorities for the head of the public service provider.

(3) Authority to appoint the Chairman and other members of the Management Council.

The Chairman and other members of the Management Council are appointed by the head of the competent authority approving the self-control scheme of the public service provider.

Structure, term of the management council in public service providers in the construction sector in Vietnam from September 9, 2024

- The structure of the Management Council includes:

+ Representatives of the higher-level management agency of the public service provider, including representatives from ministries, ministerial-level agencies, agencies under the Government of Vietnam, organizations established by the Government of Vietnam, the Prime Minister of the Government of Vietnam that are not public service providers, provincial People's Committees, and direct higher-level management agencies (if any); working under part-time policies;

+ The head of the public service provider;

+ Officials of the public service provider;

+ Representatives of related organizations, units.

- The number of members of the Management Council ranges from 5 to 11 people, including the Chairman of the Management Council, the Secretary of the Management Council, and members of the Management Council. Depending on the task requirements, the Management Council may have a Vice Chairman.

The number and structure of members of the Management Council of each specific public service provider are decided by the head of the competent authority approving the self-control scheme of the public service provider.

The Chairman and members of the Management Council are selected and appointed by the head of the competent authority approving the self-control scheme of the public service provider from the leadership representatives of the public service provider or higher-level management agency of the public service provider.

The Vice Chairman of the Management Council (if any), the Secretary of the Management Council, and other members of the Management Council are appointed by the head of the competent authority approving the self-control scheme of the public service provider.

- The term of members of the Management Council does not exceed 5 years.
