Regarding this issue, LawNet would like to answer as follows:
On March 15, 2024, the Minister and Chairman of the Committee for Ethnic Minorities issued Circular 01/2024/TT-UBDT detailing the implementation of a number of articles of the Law on Emulation and Commendation 2022 in the field of ethnic affairs.
Standards and subjects for consideration for awarding the title "Emulation Flag of the Ethnic Committee" in Vietnam are specified in Article 3 of Circular 01/2024/TT-UBDT as follows:
- The title "Emulation Flag of the Ethnic Committee" is considered and awarded to the collective that leads the emulation movement organized by the Ethnic Committee and meets the standards according to the provisions of Clause 1 and Clause 2, Article 26 of the Law on Emulation and Commendation 2022. Specifically:
+ Emulation flag title of ministries, departments, branches, and provinces to be awarded annually to the collective leading the emulation movement of emulation clusters and blocks organized by ministries, departments, branches, and provinces and meeting the following standards:
++ Exceeded emulation targets and assigned tasks for the year; is an outstanding collective in ministries, departments, branches, and provinces;
++ Internal solidarity; Party and union organizations are clean and strong; actively practice thrift; combat waste; prevent and combat corruption, negativity, and other social evils.
+ Title of emulation flag of the Ministry, department, branch, or province to be awarded to the collective leading the thematic emulation movement launched by the Ministry, department, branch, or province with an implementation period of 03 years or more when summarizing the movement.
- Subjects considered for awarding the title "Emulation Flag of the Ethnic Committee" are the collectives leading the emulation movement of emulation clusters and blocks organized by the Ethnic Committee. Emulation clusters and blocks are established according to the decision of the Minister and Chairman of the Committee for Ethnic Minorities.
- Activities of emulation clusters and blocks are carried out in accordance with the regulations and instructions of the Committee for Ethnic Minorities and the Ministry of Home Affairs.
- The Minister and Chairman submit to the Prime Minister to consider and award emulation titles and other forms of State-level commendation as prescribed; recommend ministries and central branches to award medals and certificates of merit to collectives and individuals under the Committee for Ethnic Minorities.
- Heads of Departments and Units under the Committee for Ethnic Minorities shall submit to the Minister and Chairman to consider and award emulation titles and forms of commendation to individuals and groups under the authority of the Minister and Chairman; submit to the Minister and Chairman a proposal to consider awarding emulation titles and other forms of State-level commendation according to authority; and submit to the Minister and Chairman to request ministries and central branches to award medals and certificates of merit to collectives and individuals of agencies and units.
In case of rewards for collectives or individuals with foreign elements, the submitting unit must have a written consensus from the Department of International Cooperation.
The Director of the Local Ethnic Affairs Department proposes to the Minister and Chairman to consider and award forms of commendation to individuals and groups with many outstanding achievements contributing to the development of Vietnam's ethnic minorities in the management area.
- The Head of the provincial ethnic affairs agency submits to the Minister and Chairman for consideration and awards Certificates of Merit from the Minister and Chairman to individuals in the unit; agrees with the proposal of the Chairman of the District People's Committee for cases requiring the Minister or Chairman to reward according to thematic topics; recommends awarding medals to individuals inside and outside the system of local ethnic affairs agencies.
- Heads of ministries, departments, branches, and central agencies request that the Minister and Chairman consider and award Certificates of Merit to collectives and individuals within the unit; Commemorative Medals for individuals belonging to the unit.
