Standards and Norms for Vehicles in People's Armed Forces Units

On May 30, 2018, the Government of Vietnam promulgated Decree 85/2018/ND-CP regulating the standards and usage limits of automobiles in the units of the People's Armed Forces. To be specific:

Regarding Official Vehicles

- The standards and norms for the use of official vehicles by leaders in the People's Army and People's Police, including Members of the Politburo, Secretaries of the Central Committee of the Communist Party, Members of the Central Committee of the Communist Party, Ministers, Deputy Ministers, General Directors, and equivalents, are implemented according to the Decree of the Government of Vietnam stipulating the standards and norms for the use of official vehicles.- The standards and norms for the use of official vehicles based on military ranks are specified as follows:- Officers with the highest military rank of General are regularly provided with one official vehicle during their tenure. The type and purchase price of the vehicle will be decided by the Prime Minister of the Government of Vietnam based on the actual situation at the time, upon the proposal from the Minister of National Defense and the Minister of Public Security;- Officers with the highest military rank of Senior Lieutenant General or Navy Admiral are regularly provided with one official vehicle during their tenure, with a maximum purchase price of 1.100 million VND/vehicle;- Officers with the highest military rank of Lieutenant General or Navy Vice Admiral are regularly provided with one official vehicle during their tenure, with a maximum purchase price of 920 million VND/vehicle;- Officers with the rank of Major General or Navy Rear Admiral are provided with official vehicles for travel between home and workplace and for business trips, with a maximum purchase price of 820 million VND/vehicle.- The standards and norms for the use of official vehicles at state-owned enterprises under the Ministry of National Defense and the Ministry of Public Security are implemented according to the Decree of the Government of Vietnam stipulating the standards and norms for the use of official vehicles.- In the case where one person holds multiple leadership positions with standards for using official vehicles or has standards for using official vehicles based on both leadership positions and military ranks, the highest standard will be applied. When a predecessor retires, transfers, or relinquishes the position and the provided vehicle does not meet the replacement conditions as stipulated, the successor will continue to use the vehicle; no new vehicle will be provided until the replacement conditions are met according to regulations.

Regarding Vehicles for General Work

- Leaders and commanders with a position allowance coefficient from 0.7 or higher or officials with a salary coefficient from 7.3 or higher at units of the People's Armed Forces, which are not subject to the provisions of Article 3 of Decree 85/2018/ND-CP, are allowed to use official vehicles for general work when on business trips.- The norms for the use of vehicles for general work by the aforementioned officials are to be implemented according to legal regulations. The number of vehicles provided for each organization or unit will be decided by the Minister of National Defense or the Minister of Public Security to ensure appropriateness but must not exceed the number stipulated by law.- In urgent or special cases requiring the performance of duties, the head of the organization or unit decides the allocation of official vehicles for general work for positions not covered in the above-provided regulations when on business trips.

Regarding Vehicles for General Work of Project Management Boards

- The standards and norms for the use of vehicles for general work by project management boards are determined according to the standards and norms for the use of vehicles for general work of equivalent agencies and units as stipulated by law. Note that no vehicles for general work will be provided to project management boards if the officials with vehicle use standards participate in the project management board concurrently.- Provision of vehicles for project activities must ensure efficiency, cost-effectiveness, and compliance through transfer, lease, or purchase. The Minister of National Defense or the Minister of Public Security decides on the provision of vehicles for project activities within their management scope, following the unified opinions of the Ministry of Finance.- For projects using Official Development Assistance (ODA) funds, concessional loans, commercial loans, or non-refundable aid, the implementation follows the Decree of the Government of Vietnam stipulating standards and norms for the use of vehicles.
