On September 01, 2024, the Government of Vietnam issued Resolution 126/NQ-CP regarding the specialized meeting on law-making for August 2024; which includes contents related to the Draft Law on Teachers.

Specific regulations on statutory pay rate and maximum allowance for teachers in Vietnam under Conclusion 91-KL/TW

To be specific: regarding the Draft Law on Teachers, the Government of Vietnam noted that due to the professional nature of teaching, this draft law needs to continue refining related regulations on teachers; inherit some provisions as follows:

- Adhere to and clearly reflect policies approved by the Government of Vietnam in the Proposal for law-making under Resolution 95/NQ-CP of 2023 by the Government of Vietnam.

- Continue refining relevant regulations on teachers; inherit effective, practical regulations; supplement regulations to address shortcomings and obstacles arising in reality, especially lessons learned from managing, developing, and improving the quality of the teaching workforce in recent times;

Have an appropriate roadmap and steps, ensuring feasibility and resources for implementation; ensure the correct principles and contents of state management, minimizing specific actions that are not state management;

Separate teachers from the subjects governed by the Law on Public Employees, but inherit regulations still suitable for the teaching profession from this law;

Specifically regulate special policies for teachers (in addition to the statutory pay rate and highest allowances as mentioned in Conclusion 91-KL/TW), it is necessary to design additional support policies to attract talents into the education sector, those with dedication in teaching in remote areas, border areas, and islands in an appropriate, feasible manner with the state budget resources available;

It is necessary to clarify the professional characteristics of teachers according to each education level, training level, and training method considering the unique factors in each field to form the basis for appropriate policy regulation; strong decentralization and delegation within the education management system and educational institutions, along with resource allocation, improving implementation capacity, enhancing supervision, inspection, and control of power; minimizing administrative procedures, reducing compliance costs for levels, sectors, teachers, and citizens;

Enhance public-private cooperation in training the teaching workforce, encourage self-study and self-training among teachers, create conditions for teachers to practice freely within the legal framework; assign the Government of Vietnam to regulate the teaching workforce in the armed forces appropriately and within its authority.

For specific regulations in the Draft Law on Teachers that differ from current laws, solutions to address these differences must be included in this law or related laws; it is necessary to clarify, specify in the enforcement and transitional clauses.

- Review and ensure consistency with international treaties to which Vietnam is a member; ensure that regulations promulgated are reasonable, feasible, and effective.

- Actively consult international experiences selectively, suitable to the characteristics and conditions of Vietnamese education.

- Actively consult experts and scientists; strengthen policy communications to create high consensus; effectively coordinate with ministries and central authorities and related agencies during the drafting and completion of the Draft Law.
