1. Regarding amendments to 02 Laws on entry and Exit in Vietnam

Regarding the proposal to develop a Law amending a number of articles of the Law on Entry and Exit of Vietnamese Citizens and the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam:

- The Government agrees on the necessity and goals of amending and supplementing the Law on Entry and Exit of Vietnamese Citizens and the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam to institutionalize the Party's policies, overcome obstacles and inadequacies in the implementation of these two laws; create a legal basis to promote administrative reform, decentralize administrative procedures, and implement administrative procedures in the electronic environment; create favorable conditions for people, contributing to promoting the country's socio-economic development.

- The Government basically agrees with the policy of developing 01 law to amend and supplement the 02 laws mentioned above to report to the National Assembly for approval at the 6th Session (October 2023) according to the 01 session process.

The Ministry of Public Security was assigned to preside over and coordinate with the Ministry of Justice and relevant agencies to continue researching and receiving opinions from Government Members on 04 policies; Complete the dossier for the Proposal to develop a Law in accordance with the provisions of the Law on Promulgation of Legal Documents; present it to the Government at the regular Government Meeting in March (expected April 3, 2023).

2. The Government of Vietnam to agree to change the name of the Law on Citizen Identification to the Law on Identification

Regarding the Citizen Identification Law project (amended):

- Agree on the need to develop a Law to thoroughly grasp and institutionalize the Party's views and policies; inherit appropriate regulations; overcome shortcomings and limitations of the Law on Citizen Identification 2014; continue to simplify administrative procedures and citizenship documents to meet the requirements of current and future practice; create favorable conditions to exercise the rights and obligations of citizens in transactions serving daily life;
economic and social development, contributing to promoting national digital transformation, building a digital Government and creating a digital society.

- The Ministry of Public Security shall preside over and coordinate with relevant ministries and agencies to urgently complete the Law project documents as follows:

+ Regarding the name of the Law: Agree to change the name of the Law on Citizen Identification to the Law on Identification.

+ Regarding collecting, updating, connecting, sharing, exploiting, and using information in the Identification Database (Article 17 of the draft Law): Agreed to assign the Government to detail this content.

+ Regarding issuance of citizen identification cards for people under 14 years old (Article 20 of the draft law); information integration (Article 23 of the draft Law); on transitional regulations (Article 46 of the draft Law); ... it is necessary to continue to assess the impact, review, and research carefully to ensure feasibility and avoid conflicts with relevant laws.

Regulations in the law with contents that are highly stable and consistent; for new and fluctuating contents, the Government will be assigned to regulate to ensure flexibility in administration and timely adjustment to suit reality.

Continue to review relevant international treaties to have regulations suitable to Vietnam's characteristics and conditions and the development of technology on the principle of maximum convenience for the people when using identification in transactions; ensure private life and personal secrets according to the provisions of the Constitution.

- The Ministry of Public Security presides and coordinates with the Ministry of Justice, the Government Office, and relevant agencies to research and receive the opinions of Government Members, appraisal opinions of the Ministry of Justice, and opinions of the Government Office, and complete the Law project dossier according to regulations.

Assign the Minister of Public Security, authorized by the Prime Minister, on behalf of the Government to sign and submit to the National Assembly and the National Assembly Standing Committee the Identity Law project.
