Some contents of the project on Law on National Defense Industry, Security, and Industrial Mobilization in Vietnam

Content mentioned in Resolution 135/NQ-CP regarding thematic meeting on law-making in August 2023 issued by the Government on August 30, 2023.

Regarding the Law on National Defense Industry, Security and Industrial Mobilization Project, the Government highly appreciates the Ministry of National Defense for presiding and coordinating with the Ministry of Public Security and relevant agencies to prepare and submit the Law on National Defense and Security Industry Project and encourage industry in accordance with the provisions of the Law on Promulgation of Legal Documents.

Agree on the need to develop the Law on National Defense, Security and Industrial Mobilization to replace the Ordinance on Defense Industry 2008 and the Industrial Mobilization Ordinance 2003; at the same time, institutionalize new guidelines, viewpoints, and policies of the Party and State in these fields; Complete the legal framework, including specific mechanisms and policies, creating a basis for strengthening the national defense and security industry's potential and mobilizing the industry to well perform the task of protecting the Fatherland, protecting national security, and ensuring social order and safety in the new period.

Basically consistent with the content of the Law project. The Ministry of National Defense shall preside over and coordinate with the Ministry of Public Security, the Ministry of Justice, the Government Office and relevant agencies to research and absorb the maximum opinions of Government Members to ensure the following requirements:

- Supplement the Planning for construction and development of defense industry and security industry in the draft Law; Regulations on Planning for construction and development of defense industry and security industry are national sector planning.

The Ministry of National Defense coordinates with the Ministry of Public Security and the Ministry of Planning and Investment to review the order, procedures and authority in planning work, ensuring the consistency of the legal system.

- Regarding regulations on specialized capital sources for defense and security industry development: Agree on the need to have specific financial sources for defense and security industries guaranteed from State resources, combined with mobilizing other legal capital sources prescribed by competent authorities. The Ministry of National Defense coordinates with the Ministry of Public Security, the Ministry of Finance, and the State Bank to stipulate principles in the draft Law, ensuring feasibility and synchronization with relevant laws. The order and procedures for handling specific capital sources are assigned to the Government for regulation.

- Regarding regulations on personal income tax exemption for leading experts, scientists, and general engineers in specific fields: agree that there should be appropriate incentive regulations to attract experts and scientists in this field.

The Ministry of National Defense coordinates with the Ministry of Public Security and the Ministry of Finance to present content to ensure uniformity of the legal system.

- Regarding the scope of regulation, organization, and operation of the defense industry and security industry; about the general engineer; on science and technology funds; On policies to encourage and attract experts and scientists: the Ministry of National Defense coordinates with the Ministry of Public Security and relevant ministries and agencies to review the provisions of the draft Law to ensure synchronization with relevant laws and in accordance with the authority of the National Assembly and the Government; consistency with the capacity of the Ministry of National Defense, the Ministry of Public Security and the capacity of the state budget; and ensuring confidentiality and specificity in performing national defense and security tasks.

The Ministry of National Defense presides over and coordinates with the Ministry of Public Security and relevant agencies to complete the Law project documents and ensure the quality of the Law project. Assign the Minister of National Defense, authorized by the Prime Minister, on behalf of the Government to sign and submit this Law project to the National Assembly.
