Solutions to improve policies and laws as a basis for arranging administrative units at district and commune levels
Ministries and central agencies shall, according to their assigned tasks and competence, issue documents guiding the contents assigned by the Government and the Prime Minister in this Plan, Official Telegram 557/CD-TTg in 2023. of the Prime Minister on the review and completion of regulations on the arrangement of administrative units at district and commune levels in the period of 2023 - 2030 and Official Telegram 557/CD-TTg of 2023 of the Prime Minister on reviewing and finalizing the plannings to implement the arrangement of administrative units at district and commune levels in the period of 2023 - 2030, and sent to the Ministry of Home Affairs for synthesis; send it to the locality for implementation, specifically as follows:
**Ministry of Home Affairs
- Guiding the consolidation of the organizational apparatus and dealing with redundancies for cadres, civil servants, public employees, and employees in state administrative agencies, public non-business units at district and commune administrative units formed after arrangement.
- Guiding the preparation of dossiers of application for recognition of administrative units at district and commune levels formed after the arrangement as Safe Zones, Safe Zones Communes, Island Communes, Unit Hero of the People's Armed Forces, Hero of Labor.
- Developing a master plan for administrative units at all levels for the period up to 2030 and a vision to 2045, and submit it to the Prime Minister in the fourth quarter of 2025.
**Ministry of Construction:
- Assuming the prime responsibility for, and coordinating with the Ministry of Home Affairs in, guiding localities to review and adjust urban planning for relevant expected urban administrative units to arrange administrative units at district and commune levels in the period of 2023–2025 and propose measures to ensure and continue to improve urban quality after the arrangement is completed.
- Assuming the prime responsibility for, and coordinating with the Ministry of Home Affairs in, guiding localities in reviewing, formulating, and adjusting urban and rural plannings to ensure consistency between these plans and the plan for arrangement of administrative units at district and commune levels.
- Guiding the implementation of urban classification (for cities, towns, and townships), the assessment of infrastructure development level for districts and wards when arranging urban administrative units.
**Ministry of finance:
- Guiding according to its competence the work of making cost estimates and norms; the management, use, and settlement of funding for the arrangement of administrative units at district and commune levels in central and local agencies; the handling of property, the working offices of agencies and organizations at district and commune administrative units shall be arranged; the implementation of regulations on fees and charges when carrying out the conversion of related papers of individuals, organizations, and enterprises due to changes in the boundaries and names of administrative units at district and commune levels.
- Guiding the implementation of the funding specified in Article 22 of Resolution 35/2023/UBTVQH15.
**Ministry of Planning and Investment:
- Assuming the prime responsibility for, and coordinating with the Ministry of Home Affairs in, guiding provinces and centrally-run cities to supplement content on the arrangement of administrative units at district and commune levels in the 2023-2025 and 2026-2030 periods in the provincial planning; guiding the review and adjustment of local plannings in accordance with the Law on Planning and the provisions of the law on planning for administrative units at district and commune levels subject to the arrangement for the period of 2023-2025 and the period of 2026–2030.
- Guiding the implementation of public investment capital at the administrative units at district and commune levels to make arrangements; regulations on enjoyment of investment incentives; investment procedures according to the provisions of the law on investment in border communes, coastal areas, and islands in case the arrangement of administrative units changes the geographical boundaries of the administrative units according to regulations; and the conversion of business licenses of individuals, organizations, and enterprises due to changes in boundaries and names of administrative units at district and commune levels shall be arranged.
**Ministry of Natural Resources and Environment:
- Guiding the review and supply of natural area data according to the results of land inventory of each administrative unit at district and commune level in each province and centrally run city so that localities have grounds to develop overall plans and schemes on the arrangement of administrative officers at district and commune levels and the Ministry of Home Affairs has grounds to assume the prime responsibility for, and coordinate with in giving opinions on the overall plan and appraising the project file for arranging administrative units of each locality.
- Guiding the review and correction of cadastral records after the arrangement of administrative units due to changes in administrative boundaries and names of administrative units at district and commune levels.
**Ministry of Justice:
Guiding localities to remove obstacles in the field of civil status and judicial record; guiding, according to its competence, the application of the law on relevant contents when changing the boundaries and names of administrative units at district and commune levels to make arrangements.
**Ministry of Public Security:
- Guiding the review and provision of actual demographic data at district and communal administrative units in each province and centrally run city so that localities have a basis to develop a master plan and the scheme on arrangement of administrative staff at district and commune levels, and the Ministry of Home Affairs has grounds to assume the prime responsibility for, and coordinate with in giving opinions on the overall plan and appraising the project file for arranging administrative units of each locality.
- Guiding and implement the recovery of old seals, engrave new seals of agencies, organizations and units at district and commune administrative units to make arrangements; guide the change of residential address of citizens due to changes in boundaries and names of administrative units at district and commune levels due to the arrangement.
**Department of Defense:
Guiding and conducting the review and identification of commune-level administrative units formed after arrangement as a unit in the border area, which is key for national defense.
**Ministry of Agriculture and Rural Development:
Guiding the review and implementation of policies under the National Target Program on building new rural areas for the period 2021–2025 at administrative units at district and commune levels to make arrangements.
Guiding and implementing, according to its competence, the recognition of administrative units at district and commune levels formed after the arrangement of meeting the standards of new rural areas, newly enhanced rural areas, and model new rural areas.
**Ministry of Labor - Invalids and Social Affairs:
- Guiding the review and recognition of poor districts and communes with special difficulties in flatlands, coastal areas, and islands for administrative units at district and commune levels formed after arrangement; implementing projects, sub-projects, and activities under the National Target Program for Sustainable Poverty Reduction in the period of 2021–2025 and the period of 2026–2030.
- Guiding the review and adjustment of policies in the field of labor - society, and policies for people with meritorious services at district and commune administrative units to make arrangements.
**Ethnic Committee:
- Guiding the review and adjustment of the implementation of policies according to the National Target Program for Socio-Economic Development in the Ethnic Minority and Mountainous Areas in the 2021-2030 period, arrangements will be made at commune level administrative units.
- Guiding and implement according to its competence the recognition of administrative units at district and commune levels formed after arrangement in mountainous and highland areas; Commune-level administrative units in Region III, Region II, Region I; particularly disadvantaged villages and residential quarters in ethnic minority and mountainous areas.
**Ministry of Culture, Sports and Tourism:
- Guiding the review, adjustment and implementation of the identification of the biodiversity formed after the arrangement with the relic recognized and ranked as a world natural and cultural heritage or a special national historical relic.
**Provincial People's Committee
- Pursuant to the Politburo's Resolutions and Conclusions, the Resolutions of the National Assembly Standing Committee and the Government, to promptly review and promulgate according to its competence or submit plans to competent authorities for promulgation, documents directing, guiding, and organizing the implementation, ensuring timely, closely, and effectively the arrangement of administrative units at district and commune levels in the locality in the period of 2023–2030 in accordance with this Plan.
- Directing the review, adjustment, and supplementation of local plannings (including: provincial planning, urban planning, rural planning, and other relevant plannings) ensuring conformity with the overall plan on the arrangement of administrative units at district and commune levels for the period 2023–2025 and the period 2026–2030, promulgating according to his/her competence, submitting themmit to competent authorities for consideration and decision.
- Regularly coordinating closely with the Ministry of Home Affairs, relevant ministries, and central agencies to promptly remove obstacles and difficulties in the arrangement of administrative officers at district and commune levels in the locality.
