Severance allowance for officials in the People's Army of Vietnam

This is the main content stipulated in Circular 148/2010/TT-BQP guiding the implementation of resignation policies for officials in the People's Army of Vietnam issued by the Ministry of National Defense.

Article 2 Circular 148/2010/TT-BQP stipulates on this matter as follows:

1. Conditions for allowance entitlement

Officials who resign due to personal wish, approved by authorized heads of agencies or units: 2 consecutive years of not completing tasks; a reduction in working capacity by 61% or more but less than 20 years of paying social insurance; reaching retirement age (men 60 years old, women 55 years old) but less than 20 years of paying social insurance are entitled to severance allowance policies.

2. Allowance level

Officials meeting the above conditions, upon resignation, in addition to the one-time allowance policy as per the Law on Social Insurance, will receive an additional allowance as follows:

For each working year with social insurance contributions (if interrupted, it will be accumulated), without receiving severance allowance or demobilization allowance, an allowance equal to 1/2 (one-half) of the current monthly salary will be given. The minimum allowance is equal to one month's current salary.

The one-time allowance upon resignation is calculated according to the following formula:

- Total allowance = Total time of social insurance contributions x 1/2 month x Current monthly salary

3. Basis for calculating allowance

The monthly salary for calculating the severance allowance stipulated in clause 2 of this Article includes: salary according to rank, grade, leadership position allowance, seniority allowance exceeding the frame, and reserved differential coefficients (if any).

- Calculation time:

Implemented according to the provisions in Article 6 of Decree 46/2010/ND-CP.

Example: Comrade Nguyen Van Tan, 32 years old, Accountant of agency A, has 14 years and 4 months of working time with social insurance participation. Due to difficult family circumstances, he requested to resign and was approved by the unit, effective from December 1, 2010. The current monthly salary of Comrade Tan in the month adjacent to the resignation is: 3,416,400 VND (rank 06.030, grade 3, coefficient 4.68).

Before Comrade Tan's resignation, in addition to the one-time allowance policy enjoyed under the Law on Social Insurance, he also received an additional severance allowance of:

- 14.5 years x 1/2 month x 3,416,400 VND = 24,768,900 VND.
