Sentenced persons are still allowed to be considered of change of place of residence in Vietnam

On November 28, 2019, the Ministry of Public Security promulgated Circular 64/2019/TT-BCA regulating the settlement of cases where persons released from prison before the stipulated term with conditions, persons granted suspension of sentence execution, persons enjoying suspended sentences, and non-custodial reform change their place of residence in Vietnam.

According to Article 3 of Circular 64/2019/TT-BCA, a sentenced persons may be considered and approved for a change of residence if the following requirements are met:

1. Compliance with legal requirements on residence.

2. Having a legitimate reason for changing residence, falling into one of the following cases:

- Living with family and the family relocates to another place;

- Moving to reside with spouse after marriage; relocating after divorce;

- Moving to reside with father, mother, grandfather, grandmother, child to fulfill obligations of care and nurture in cases where the father, mother, grandfather, grandmother, or child is seriously ill without anyone else to care for, or in cases of elderly without support;

- Moving to another place of residence to ensure work or study;

- No longer having a place of residence due to demolition, natural disasters, fires, wars;

- Forced to sell the house to overcome consequences or ensure livelihood;

- Due to epidemic reasons or ensuring national defense and security requirements;

- Other cases decided by the Criminal Execution Management Authority under the Ministry of Public Security of Vietnam.

3. The relocated residence must have a specific, clear, stable, and long-term address.

4. The approval for the change of residence for the sentenced person must ensure it does not affect security, order; ensure the requirements of management, supervision, education of the sentenced person and the stability of life, community integration of the sentenced person.

More details can be found in Circular 64/2019/TT-BCA, which comes into force in Vietnam from January 15, 2020.
