Regarding this matter, LawNet would like to answer as follows: 

On April 22, 2024, the Minister of the Ministry of Public Security of Vietnam issued Circular 14/2024/TT-BCA guiding the Law on forces participating in security and order protection at the grassroots level 2023.

According to Article 3 of Circular 14/2024/TT-BCA, regulations on the selection process for members of the Security and Order Protection Team in Vietnam as of July 1, 2024 are as follows:

(1) Formation and public announcement of the selection plan:

- Based on practical requirements, the local police department will develop a selection plan for members of the Security and Order Protection Team to meet the requirements of maintaining security and order at the local level and submit the plan for approval by the local People's Committee.

The plan should include: objectives, requirements, criteria, conditions, documents, number of members to be selected, deadline and location for receiving applications, estimated date for the selection meeting, and other relevant information.

- Once the local People's Committee issues the selection plan, the local public security department will publicly announce the plan at the headquarters of the People's Council, People's Committee, local public security department, as well as at cultural centers and community gathering points in villages and residential groups.

(2) Receiving applications and publicly announcing the list of applicants:

- The local public security department will receive applications. In the event that the applications are incomplete or do not comply with the regulations, the receiving department is responsible for notifying the applicants immediately upon receipt and providing guidance on how to complete the applications.

- After the deadline for receiving applications, the local public security department will compile a list of applicants and submit it for approval by the local People's Committee. The list of applicants will also be publicly announced at the headquarters of the People's Council, People's Committee, local police department, as well as at cultural centers and community gathering points in villages and residential groups, at least 15 working days before the selection meeting.

(3) Establishment of the Selection Council:

The Chairman of the local People's Committee will decide to establish the Selection Council (in accordance with Form No 08 attached to the Ministry of Public Security's Circular 14/2024/TT-BCA). The Selection Council consists of the Chairman, who represents the leadership of the local People's Committee, the Vice Chairman, who is the head or deputy head of the local public security department, and members representing the local Ho Chi Minh Communist Youth Union, Vietnam Women's Union, Vietnam Farmers' Association, commune-level officials, and representatives from villages, residential groups, and Front Affairs Committees (hereinafter referred to as the Selection Council members). The number of members in the Selection Council is determined by the Chairman of the local People's Committee.

(4) Organization of the selection meeting:

- The selection meeting will be held after the deadline for publicly announcing the list of applicants, and the specific date will be decided by the Chairman of the Selection Council.

The Selection Council meeting will be held when more than half of the total number of members attend, and the Chairman or Vice Chairman of the Selection Council, who is authorized to preside over the meeting, must be present.

- The selection process will be based on the criteria and conditions specified in Article 13 of the Law on Security and Order Protection at the grassroots level in 2023, as well as the selection documents specified in Circular 14/2024/TT-BCA.

(5) Procedures during the meeting:

- The Chairman or Vice Chairman of the Selection Council, who is authorized to preside over the meeting, will announce the purpose, requirements, and agenda, and provide information such as the list and background of the applicants, criteria and conditions for participation, list of Selection Council members, selection method, minutes secretary, and other relevant information.

- If the selection is conducted by an open show of hands, the minutes secretary will count the number of members present and record the results in the minutes, which will be confirmed by the Chairman or Vice Chairman of the Selection Council and the minutes secretary. The results will also be publicly announced during the meeting (according to Form 04 attached to Circular 14/2024/TT-BCA).

- If the selection is conducted by secret ballot, the ballot papers will be sealed with the stamp of the local People's Committee (according to Form 02 attached to this Circular). The Selection Council will form a Ballot Counting Team consisting of the team leader, deputy team leader, members, and secretary. The Ballot Counting Team will count the votes immediately after the voting and record the results in the minutes, which will be confirmed by the team leader, secretary, and publicly announced during the meeting (according to Form 03 attached to Circular 14/2024/TT-BCA).

(6) Selection results and public announcement of selection results:

- Citizens who undergo the selection process to be recognized as members of the Security and Order Protection Team must receive the agreement of more than half of the total number of Selection Council members present at the meeting or voting.

If the number of citizens participating in the selection process exceeds the number of team members to be selected, the Selection Council will prioritize the candidates based on the number of members present at the meeting, starting from the highest to the lowest, until the required number of team members is fulfilled.

In case of a tie vote, the Chairman or Vice Chairman of the Selection Council, who is authorized to preside over the meeting, will make the final decision.

- Within a period of 3 working days from the date of the selection results report, the local police department will publicly announce the selection results at the headquarters of the People's Council, People's Committee, local public security department, cultural centers, and community gathering points in villages and residential groups. The selected candidates will also be notified at their respective addresses, and they will be informed about the date to receive their duties in case they are selected.

More details can be found in Circular 14/2024/TT-BCA, which comes into force from July 1, 2024.
