Scope of Maritime Works Protection in Special Cases

- In cases where the maritime construction protection zone overlaps with the protection zone of flood and storm prevention works or dyke protection, it shall be implemented according to the relevant provisions of the laws on flood and storm prevention and dyke protection.- In cases where the maritime channel protection zone overlaps with the safety corridor of roadways, railways, or extends beyond the natural shore edge towards the land, the maritime channel protection zone shall be determined up to the natural shore edge.- In cases where the maritime construction protection zone overlaps with the inland waterway safety corridor, the maritime channel protection zone shall be determined up to the inland waterway safety corridor.- In cases where the maritime construction protection corridor overlaps with the safety corridor of road bridges, railway bridges, power lines, or cable cars, it shall be implemented according to the relevant provisions on the protection of the safety corridor of bridges, power lines, and cable cars.- In cases where the maritime channel protection zone overlaps with the protection zone of port works or piers, the maritime channel protection zone shall be determined up to the protection zone of port works or piers.- For specialized cargo handling marine port works and regulatory works, the minimum safety corridor must comply with the provisions of this Decree. Additionally, the safe distance must also comply with the relevant regulations for specialized cargo handling piers or related regulatory works.- In cases where the maritime construction protection zone is related to adjacent national security and defense works, the consensus opinion of the Ministry of Public Security or the Ministry of National Defense must be obtained.- In cases where the maritime construction protection zone overlaps with the coastal protection corridor, the maritime channel protection zone shall be determined up to the coastal safety corridor.
